I am on a limited contract for 2 years, with an Abu Dhabi visa. I have already completed 6 months of probation.

If I resign now, should I pay anything to the employer?

If yes, then will this amount be based on the basic salary or full salary?

Are the visa expenses borne by the employer?

Dear questioner,

Following the current UAE Labor Law, in your case, you have already completed your probation period, if you resign from your job, you must give your employer written notice of at least 30 days and no more than 90 days.

During the notice period, you must continue to work for your employer unless he allows you to leave.

Hence, you will be required to pay compensation to your employer if you resign now and do not comply with the Notice Period.

The compensation shall be equal to the Worker’s Remuneration for the entire Notice Period or the remaining part thereof.

Furthermore, the Employer shall be prohibited from charging the Worker the fees and costs of recruitment and employment or collecting them from him, whether directly or indirectly.

Only in the event that the Worker wishes to move, during the Probation Period, the new Employer shall compensate the original Employer with the costs of recruitment or contracting with the Worker, unless agreed upon otherwise.

As a result, visa expenses must be borne by the employer even if the employee has not completed the two-year visa period in service.
