Landlord sent renewal notice to wrong email address - can we refuse rent increase?

Dear Sir/Madam,

My landlord sent me an 86-day renewal notice to an old email address that is no longer working, even though we updated our email address and phone number in their system last year.

We did not know about the notice until my wife emailed them to follow up regarding our renewal, and they sent us a screenshot of the notice under the old email.

The rent increase is from AED 27,000 to AED 32,000 which is not in line with the RERA guidelines.

Do we have a good chance of winning a complaint if we file one?

Dear Questioner,

Yes, to some extent, no landlord can increase rent beyond the RERA index.

Dear Client,

Thanks for your question! I hope you are doing well. I will definitely assist you in this matter.

In the UAE, landlords are required to give tenants at least 90 days notice of any rent increase or lease termination.

If your landlord provided less than 90 days' notice to an outdated email address, it may be worth discussing the situation with the Dubai Rent Committee or Real Estate Regulatory Agency (RERA).

They can provide guidance on whether you have a valid case for dispute and can assist in resolving the matter.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will definitely be happy to help you.

Thanks & Regards,

ABDUL WAHIED

Hi,

Since the landlord gave you only 86 days' notice, he cannot make any changes to the terms of the tenancy contract including your rent.

So, the tenancy contract will be renewed at the existing terms and conditions.
