Can I send an eviction notice to a tenant while the contract is valid?

Dear Sir/Madam,

Can I send an eviction notice to a tenant while the contract is valid?

The current tenancy expires in December 2023.

If I send it now, will he have to vacate by August 2024 or December 2024?

Dear Client,

Thanks for your question! I hope you are doing well. I will definitely assist you in this matter.

In the UAE, sending an eviction notice to a tenant before a valid tenancy contract expires requires careful consideration.

Review the contract for early termination clauses and adhere to notice periods, which could be around 12 months.

If you send a notice now, the tenant might need to vacate by August 2024 or December 2024, depending on the notice period.

Dear Questioner,

If you, the landlord, are issuing the tenant with the notice within the final 3 months of the current tenancy agreement, you are legally required to provide the tenant with the option of renewing the tenancy for another full year and vacating via the new expiry date.

If the tenant is to receive the notice 90 days before the current lease expires, you are then within your rights to request that the lease be renewed up until the end of the 12 months’ notice.
