How to evict a tenant in Dubai as a new owner before receiving the title deed?
Hi Legal Advice ME,
I have just bought an apartment in Dubai with a tenant in place. I would like to move into the apartment as my residence.
I understand that I must issue the current tenant a 12-month written notice. However, I have only received the sale and purchase agreement (SPA) from the developer so far.
Do I need to wait until I receive the title deed before issuing the eviction notice?
Also, the current Ejari is between the developer and the tenant. Can I still issue the 12-month notice even though the current tenancy contract is with the developer?

Yes, you may issue the 12 months eviction notice which is done through Dubai courts/public notary even if you did not receive the title deed.
Considering the fact that you are not the lessor, it is still valid to give such notice as this is what it was designed for.

The developer must serve such notice on your behalf and attach the initial SPA to this notice.
I would not recommend serving such notice as long as the developer can.

The developer can also issue an eviction notice for the reason of the sale of the apartment.
When the property is transferred into your name, the eviction notice will be still valid.
Only you have to serve him a notice regarding the transfer of the title deed.

You have to wait for the title deed and send a notice 10 days before the expiration of the lease — a 12-month notice.
