1
Q: Dear Sir/Madam,
I resigned from my company during my probation period at Hamriyah Free Zone Sharjah. I gave my company 30 days' notice in writing via official email.
After 21 days of my notice period, my employer verbally told me to discontinue working and that handing over was enough. I immediately sent an email to my employer to confirm what they had advised me.
After 3 days of discontinuing work, my employer sent me an email stating that my resignation was not accepted because there was no valid reason for resigning.
My employer has not canceled my visa even though one month has passed. I have already filed a case in court and the hearing is on October 23 (which is one month after the end of my probation period, if it is 6 months long).
What can I expect now? If my employer cancels my visa after the court hearing, does my new sponsor need to compensate my ex-employer?

New job demands immediate cancellation; current employer refuses. What now?

2
Q: Dear Sir/Madam,
I got a new job, and they want me to cancel my current employment visa within 2-3 days or risk losing the opportunity.
They promised to pay the fine for the 30-day notice, but my current employer won't accept it since there's no replacement for my position.
Is there a way to cancel my current visa or a good solution for this?

Am I responsible for insurance and visa fees upon early contract resignation?

2
Q: Dear Sir/Madam,
My contract is for 2 years, limited. I resigned after 1 year and 5 months. The company asked me to cover medical insurance, labor insurance, visa status change, and Emirates ID charges.
Am I liable to pay this amount to the company? Please let me know the calculation of the leave salary.
Is the calculation based only on basic salary and HRA allowance or the full salary including all allowances?

Go to Saudi Arabia for a company project or resign and pay visa expenses. What to do?

2
Q: Hi,
My visa was renewed four days ago in the same company. After the visa renewal, the company is demanding that I go to Saudi Arabia for a one-year project with a Saudi business visa.
However, I do not want to go to Saudi Arabia. The company is giving me only one choice: either I go to Saudi Arabia or resign and pay the expenses of the visa renewal.
What should I do?

Can I cancel my house sale contract without extra fees after personal plans changed? 2
Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Tenant always late with payments, hasn't renewed contract. What to do? 2
Hello,
I have a tenant who is always late with their payment. Their renewal was supposed to be last December 2023.
Currently, they have not signed any new contract, provided any new cheques, and have stayed for three months from December until now without paying rent.
Additionally, I just discovered that they have sublet the apartment with partitions, which is clearly stated as not allowed in the old contract.
Please let me know what should I do legally!

Tenant received renewal notice, rejected proposed rent on renewal day. What next? 2
Hi,
We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent.
The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn't be paying the proposed rent.
Due to the argument, the landlord decided to reduce the rent, but the tenant has not yet renewed his contract. It has been 12 days since his contract expired.
Kindly suggest what could be done in this matter.

My previous organization has not yet released EOSB because I contacted a client. Is this legal? 0
I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

Does filing an online rental dispute by a landlord lead to a travel ban on the tenant? 0
Hello,
Does the initiation of an online rental dispute case by a landlord in Dubai automatically lead to the imposition of a travel ban on the tenant?
This is not related to bounced cheques; the dispute concerns wear and tear versus damage claims by the landlord.

How can we claim our money back if the cheque we received have bounced for insufficient funds? 0
We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day.
We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds."
We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it.
We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.
