Q: Hi I let my friend use my cheques for rental payments for her apartment which she is renting. Unfortunately, she did not deposit the money until it was the due date so there was a bounced cheque and the real estate included my name for the travel ban case that they filed against my friend.

Q: I had to evacuate the apartment due to a case filed by my landlord in RDC in March 2018 on unpaid rent of AED 30,000. The keys were handed over to RDC. I am going through severe financial issues and it is very difficult for me to arrange the said amount. The landlord has also filed a case of bounced cheque. What remedies do I have as my financial situation is quite stressed to get rid of this case?

Q: Hey I rent an apartment in a building managed by a bank and had a one-year contract. They changed the management after three months of the contract. And then I had a bounced cheque so I went to the bank that was currently managing the building and paid them in cash. They said the old bank will send me my cheque back within a month. But after a few months, I received a message from the police that I have a criminal case so I went to check and found out that I have a travel ban as well. My mom was sick and I was traveling with her on Sunday and this happened on Thursday, 2 days before that. I went to the bank and got to know that they received the email but yet they filed the case by mistake and until this day I haven’t received my cheque back. It’s been 10 months now. Kindly let me know if I have a case.

Q: My friend is outside the country and his rent cheque bounced. What will happen when he enters the country again? What are the consequences? Will he get a travel ban? Will he be arrested at immigration when he enters the airport?

In the UAE, cheque bounce is a very frequent problem faced by people during their span in the country. It is covered under the purview of Commercial Transactions Law, and legal implications/penalties can be financially severe and daunting for more “serious” offenses. Bounced cheque issues may arise in a variety of commercial transactions, including but not limited to, companies’ exchanges, bank loans, property rents or purchases, and individual transactions.
