What should we do if our resigned employee claimed unused air tickets in court?

Hi,

Our resigned employee filed a labor complaint in MOHRE to claim unused air tickets amount. As it was not amicably settled, labor transferred the same to the court.

But till now we didn't get any intimation from the court as maybe the employee didn't register the complaint. So what will be the next step taken by the company?

If we transfer the gratuity amount to the employee's account, then can he approach the court again regarding the unused air ticket claim?

Please advise.

No, do not transfer any amount as long as he went to court.

When he files his case, you can offer to pay his gratuity.

When the employee registers the complaint, the court will send you a notice of that.

Yes, he can file a separate complaint to obtain the air ticket allowance.

You have to do a counterclaim against him and you have to pay his dues only in court.

Transfer the bonus amount to the worker on his personal account stating the reason for the transfer.

Hi

It will be advisable to take in writing that the employee received the entire EOSB along with the annual tickets and while making the transfer, specify the details.
