The process of a labor case hearing if the employer does not attend
Good day everyone!
Can anyone help me to find answers to some questions?
Thanks in advance.
Since I am new in Dubai Courts, I had a couple of questions.
I filed a labor case in MOHRE regarding non-payment of gratuity. MOHRE accepted my complaint and they refer me to the court.
I filed a case in court and I am waiting for my case number and date of hearing. Now, my questions are:
1. What would happen on the first hearing?
2. When is the second hearing?
3. How long does a labor case take in court?
4. Can I claim compensation if my employer appeals in court?
5. What will happen if the employer did not attend the 1st hearing?
Thank you in advance.

If the other party is correctly notified, he is expected to attend and submit at the first hearing.
The second hearing will be announced at the end of the first hearing. Labor cases are faster, however, it will depend on the other party's submission.
You can claim compensation if you were terminated without a valid reason. If the employer does not attend the first hearing, then the court will notify them again by the newspaper.
Court sessions are attended remotely using Microsoft Teams. To access the link on the day of the hearing, you will need to create a profile on the Dubai Courts website.
On the day of the hearing, you must access your profile on the Dubai Courts website, search for your case and access the hearing link.
Regarding language, you can request an interpreter before the session to interpret during the session.
For more information on remote court hearing guidelines, you can contact the courts by phone or via WhatsApp at the same number.
I assume the notification procedure is still being processed and not completed yet.
The court may ask you to circulate a notice of the hearing during the next hearing, which is the final stage of the notice.
Once this is done and the employer does not attend the hearing, you can ask the court to issue a judgment in the absence of the other party.
Hope the above explanation is satisfactory to you
Hi,
The judge will ask all parties to submit their defense, then he gives judgment.
It will take 2 months, you can ask for compensation. If he does not attend, the judge will give judgment in his absence.
For more information, contact us by phone.

No one can give you a specific reply on all this, it's all related to the court procedures and the judge's decision.
But if the employer didn't attend many hearings not only the first hearing, the judge will issue his judgment.
