Q: Hi,
I just bought a villa in Dubai, wherein the previous owner had served an eviction notice in Aug. to the tenant with the reason that he intends to sell the property.
Based on this eviction notice, I bought the property, and now I was told that I need to serve a new eviction notice to the tenant again as a new owner.
If I do this, then the tenant will get 12 months to vacate from the new notice date. Then what is the use of the old eviction notice?
As I understand the new owner will need to honor all obligations of the old landlord and in which case the new landlord should also be entitled to the right of eviction notice served by the old landlord, right?

Q: I just happen to buy a property and sign the papers today. The property is occupied till 30 June as the tenancy also expires on the same day.
I was not informed by the previous owner that the tenants are going to renew the contract. They did not send an email to the previous owner of their intention to renew the contract.
I am a female, I have not renewed my old contract and have no place else to shift. Can I get the tenant to vacate and move to the property?
Please guide.

Q: I purchased a villa in Jan 2023 which had a 12-month vacating notice by the previous owner for the reason of selling the property (tenant to vacate 30th June 2023).
The tenant now informs me that he is not obliged to vacate as the reason for vacating is no longer valid since the property is sold and I am the new owner.
Now the tenant is mentioning that he believes a fresh notice needs to be given with another 12 months' notice.
When I called the RDC of RERA, they mentioned that the new owner needs to give fresh notice.
I want to understand the below:
1) Do I need to give fresh notice of 12 months to my tenant?
2) Is the eviction notice sent by the previous owner still valid?

Q: Hi There,
Here is my current situation:
I have just bought a property, and the previous landlord issued an eviction due to the intention to sell, valid until 9th Nov 2023. It was sent by Dubai Courts, and the previous tenant acknowledged it.
The new tenant is refusing to leave and said that I have to serve a new 12-month notice to them.
I do not want to send a new notice, as I do not plan to live in the property, I plan to rent it (they are paying 42K AED under the market and not even covering the mortgage) for a few years before moving in.
My questions:
a) Can I send a legal letter from a notary public, referencing the previous notice which is still valid, from Dubai courts?
b) If so, can I legally evict them on the agreed date, and will RERA be in my favor?
c) If they do leave, am I able to rent the property?
I never stipulated an intention to move in on the notice, as it was the previous landlord's notice which is "intention to sell".

Q: Dear Sir/Madam,
I bought an apartment in July, and the previous owner gave a legal notice in November, stating that he is selling the apartment.
The contract ended in September. Is the legal notice still valid for the new owner? The tenant refuses to leave, and I rejected the security deposit check because I want to move in at the end of the notice period.
Should I give him another notice?

Q: Dear Sir/Madam,
I am a European resident and have owned an apartment in Dubai since November 8, 2023. The contract with the previous owner ended in September 2023, and the tenant was served an eviction notice until July 2024.
I find the tenant's behavior very problematic and am considering legal action. He has not paid any rent to me since I took ownership.
I invited him for a new 1-year contract without a rent increase, but he insists on forcefully signing the contract at the Dubai Land Department without my or my POA's signature and is compelling me to visit Dubai to collect the cheques.
Can you help with the following:
1) How can I get my rent?
2) Can the Dubai Land Department enforce the lease contract without my approval?
3) Given his behavior, I do not want to continue the lease agreement with him. How can I evict him as early as possible?

Q: Hi
We are in the process of buying a residential villa in Dubai which is currently tenanted. The seller did not issue an eviction notice to the current tenant.
However, the following sentence was added to the contract:
“As agreed, this will be the last renewal period for the tenant. The tenancy contract will not be renewed or extended. At the end of this contract, the tenant will vacate the property on 11/01/2025.”
On the above basis, is the tenant obligated to vacate on the above-mentioned date even after the property is transferred to me?
If so, do I need to send them an eviction notice for 11/01/2025?
Or a 12-month notice would need to be sent?

The applicability of the existing contract between the previous owner and tenant to the new owner

Q: Hello,
I am buying an apartment to live in. The only problem is that the apartment is currently rented, and the tenant's contract will end at the end of November. We talked with her, and she is willing to leave earlier.
The real estate agent just sent me the contract between the current owner and her, which states that: "The landlord has to submit 60 days' written notice prior to the end of the contract to the tenant to inform them of any changes in the rent or terms and conditions (including vacating notice) of the tenancy contract."
So, if I buy this apartment, will the rules stated in the contract between them apply to me as well?
In the draft of Contract F, we also wrote that upon the completion of the transfer, the seller undertakes to send a notice directly to the tenant, in accordance with Clause 4.3 of the tenancy agreement, providing a minimum of 60 days' notice.
Per Clause 4.3, the tenant is expected to agree to vacate the unit. Could this be enough?

I am writing to seek your legal expertise and advice on a pressing issue concerning a property sale transaction that my brokerage company has facilitated.
Here are the details:
Our brokerage company represented the seller in a property sale where the property was sold with an existing rental agreement in place.
As per the terms of the agreement, the rental balance was supposed to be given to the buyer, who is now the new owner of the property.
In this transaction, our company is entitled to a 40% commission, and the buyer's brokerage company is entitled to 60%.
However, the buyer's brokerage company, which has complete control over the buyer's funds, has transferred the entire 100% commission to their own account.
They are currently withholding this commission, stating that they will release it once the rental balance is paid to the buyer.
Unfortunately, we have lost contact with the buyer, as he has blocked the seller's agent, making it impossible for us to fulfill this condition.

I applied for Canada AIPP programs from one of the consultancy agencies in Dubai in 2021, and they told me it would take 1 year for the process. Now it’s more than 2 years.
They told me they were applying for me these years but I didn’t get any response from any company, and when I asked them to tell me where they applied, they told me it's confidential.
Now I told them to stop my process and they will refund my money but it will be very much less as per them.

On Jan 2, 2025, one of my close friends did a privacy breach and recorded me and my van in some specific place.

I have a question regarding an immediate eviction petition to the Urgent Judge. The tenant did not return the apartment on 26 January 2025, despite a 12-month legal notice that ended on 25 January 2025.
The tenant rejected all gas and fire prevention maintenance for 12 months. Al-Fanar Gas submitted a report with the tenant's signature and refusal after the tenant broke the gas detector.
The apartment was sold, and the new owner gave the tenant 90 days' notice. The tenant refused to show the new owner the apartment and ran away, according to building management.
The tenant ignored the 12-month legal notice, did not return the apartment, broke the gas detector, and refused gas and fire detection system maintenance.
The deal will be voided if the new owner cannot enter the property promptly. Can I petition the Urgent Matters Judge for quick eviction based on the tenant's violations?
