A contractor did waterproofing on my roof but water leaked and made damages. What can I do?

A contractor recently did waterproofing on my townhouse roof and confirmed a warranty of 5 years (on WhatsApp). The payment receipt and invoice are available.

In 4 months, water leaks from the roof damaged the false ceiling inside the house. When contacted, he avoids calls and delays by making some excuses.

Is there any way I can get my money back?

If the contractor fails to respond or resolve the issue, you can file a complaint with the UAE Consumer Protection Department, which is part of the Ministry of Economy.

The UAE has a strong Consumer Protection Law, which mandates that any product or service sold to a consumer must meet reasonable expectations of quality and durability.

This applies to services like waterproofing as well. Under Federal Law No. 24 of 2006 (the Consumer Protection Law), if a service is defective or fails to meet the standards promised, the consumer is entitled to a remedy—whether that be a repair, replacement, or refund.

I filed a complaint but they closed it stating that the invoice doesn't mention warranty. Only WhatsApp messages can be valid in Dubai courts.

From the above explanation, there is a default from the contractor as he gave a false promise of a five-year warranty.

If we have enough evidence of his breach we can claim this amount back. It would be better if we could serve him a legal notice regarding the breach and demand a refund.
