Q: Hi all,
I hope you are well!
I have a question regarding a dispute with my employer and I am currently awaiting for hearing on my case. I have submitted my resignation with the intention to complete 30 days notice period due to false allegations leveled by the employer.
It did not go down well with them and refused to accept my resignation and took my laptop and access card and sent me a termination letter after 4 days. It was an arbitrary dismissal with a refusal to accept my resignation.
My question is whether I will be correct to put forward a claim for arbitrary termination and a claim for damages per court decision including my gratuity and pending leaves.
The employer has no intention to make payment and is threatening me with a police case and a bad referral for future employment.
Please guide me on this situation as I wait for a hearing from the Dubai court.

Q: Hi.
I resigned from a company 8 months back but I didn't get my settlement and pending salary, and I was asked to sign the settlement paper for visa cancellation.
Since I was about to join another company, I signed the paper and wrote an email to the HR saying that I'm yet to get my settlement when I left the company. It's been 8 months and I registered a complaint against them.
They are saying that they will put a criminal against me saying that I stole materials and I used to get commission from suppliers and subcontractors, which is not true.
From my side, I have two disputes even though I have not got any money from anybody and I have not stolen as claimed by them.
1. I was planning to start a business with one of my subcontractors and I abandoned that plan. My company is aware of that.
2. I accepted one of my subcontractor's invoice bill before the LPO was issued to them as instructed by my project manager.

Rejecting employee's resignation and withholding his passport

Q: Dear sir/madam,
Immediate resignation was rejected. The job I am doing is not in my signed contract. The amount paid is in my contract but does not match the duties given to me. I was stopped from doing what is in my contract or else to resign & go home.
I have audios of phone calls being threatened by C.E.O.
All this is because they have my passport in their custody, therefore, they promised that I won't go home till I die and I have evidence of this statement.

Do I have to serve my notice period after completing my rotational leave?

Q: Good afternoon.
I have been working with my employer for the past 3 years and 9 months. According to my contract, I am required to work 42 days and take 21 days of unpaid rotational leave.
6 months ago, my employer changed my rotational working cycle to 60 days of work and 60 days of unpaid leave. I did not agree to this change, but I have been working under this new cycle for the past 3 rotations.
I resigned from my job while I was on rotational leave and requested to be released from my contract with a 30-day notice period.
However, my employer informed me that I must first complete my rotational leave, which is 60 days, and then serve a 30-day notice period after returning to work.
I have another job that I need to start in 20 days, but my current employer is not releasing me. I officially submitted my resignation via email on July 12, 2023, from India.
Due to this issue, I traveled to Abu Dhabi on July 18, 2023.
Please advise me if I must serve my notice period after completing my 60-day rotational leave, or if it can be calculated from the date of my resignation.

Good day.
I would like to ask about this scenario.
This 1 staff sent a resignation due to delayed salary but the management agreed to reject his resignation and talk to him that the company still needs him.
This staff accepted the proposal then later on after 3 months, this staff did not go to work. It's like he will come twice a week and then he will not come again.
Now he sent an email to give him a termination letter. The management decided to accept his resignation ssubmitted 3 months ago but this employee wants a termination letter.
What is right? Is it okay if the management accepts his resignation?

Q: Hi.
I had to make some employees redundant as per their contract, and I gave them a notice period.
One employee who I made redundant wants to leave in his notice period for a new role to begin next week and wants me to cancel his visa.
In this scenario, what do I owe him legally other than his gratuity payments?
Do I still need to pay his full notice period for redundancy?

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property 0
Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.

Lawyers misunderstood my question. Please read carefully and then guide me.
Case Type: Civil Case
Claim amount: 400,000
Paid: 65,000
Reason: Commercial agreement of supply
Emirate: Ajman
This case was registered in 2022. The judgment was in my absence, as notices were sent to the wrong address.
I was sent to jail. I made a down payment, bailed, and paid some more amount as installments. The total paid amount is AED 65000.
Now, again, an arrest warrant is issued as I did not pay the remaining 335,000 of the claim.
According to me, I had to pay only this amount because the executioner made a wrong claim, not as per the genuine claim.
So I want to reopen the case file.
I want the court to reinvestigate and start the case from scratch.
1) How can I make that request?
2) What documents are required?
3) Chances of reopening of case?
4) Cancellation of arrest warrant
Please guide me in detail, as I will do everything myself, as I cannot afford a lawyer right now.

I booked a hotel stay for Eid through a travel agency two weeks before Eid. The travel agency confirmed the booking on payment.
One day before Eid, the agency reached out, saying they had an issue with the supplier/hotel and the booking would be cancelled.
They offered alternative hotels that didn’t match the original property. I suggested some properties, and they couldn’t arrange them, or they asked for further payment, so I didn’t book anything through them.
What are my rights to a refund and compensation, as I had to book other arrangements separately at a significantly higher cost due to the last-minute prices?
It also caused significant emotional distress, less than 24 hours before the holiday. To which authority can a complaint be made in case of an unsatisfactory outcome?
Both the agency and the hotel are in Dubai.

How can I renew my Ejari if the landlord hasn’t signed the new contract? 0
Hi,
I have been here for 3 years now and paid the increased amount (as per the agreement) for the 4th year.
However, the landlord did not send me back the signed contract, although I have both made the payment for the full year via bank transfer and sent my signed contract to him.
I need to renew my Ejari; however, how can I do it without the landlord's signature?
I have all the previous contracts signed by both parties, along with the Ejari for those contracts.
