Rights of the wife and daughter with the father in a divorce agreement
2
Q: Hi,
I am Indonesian and my husband is French and we got married in Indonesia under Sharia Law.
We reside in Dubai with our 3-year old daughter. As we decide to separate, I found out that my husband already has a girlfriend.
We agreed to divorce and we drafted an agreement by ourselves, but I feel the amount of child support and maintenance fee is not fair. Before I sign it, I want to ask, is there any specific calculation for child support and wife alimony in Sharia Law?
My husband also threatened to take my daughter away from me if I mention anything about his adultery.
What is the best and fairest way for me to have my right as a woman, wife, and mother and to also protect my daughter’s wellbeing from her irresponsible father?

Mother's reunification with daughters while there is a divorce process

2
Q: Hi,
I am a Muslim mother of two daughters, aged 3 and 6. I am in the process of a divorce and my husband has taken my daughters away from me, despite my legal custody of them.
I reached out to the authorities, but when I saw my daughters one month later, they refused to come with me.
My husband and his childless aunt have manipulated them. I have a good record as a good mother, I work, provide for my daughters, and they have great school records. We participate in many activities.
The father is a drug addict and has been in psychiatric care several times (a report will be provided as the court has officially requested it). Additionally, he has not paid for the children's welfare since 2020 and there is an arrest warrant against him.
He left the marital home 2 and a half years ago.
What should I do to get my daughters back?
The aunt is also taking pictures and videos and sending them to social media without my consent as the legal custodian.
Can I sue her for this?

Despite custody court order, ex-husband does not return kids. What to do?

2
Q: Dear Sir/Madam,
I am a French resident in the UAE, living in Dubai. I recently got divorced from a UAE national. My husband took my kids away a year ago, and despite having custody granted by the court for over a year, he has not returned them to me.
I have attempted to see them at their school (a public school in Dubai), but the principal wouldn't allow me, even though I am the legal custodian and mother of the kids.
What can be done?

Can the wife lose the custody of her children due to a medical condition?

Q: I am a Hindu and my husband has filed for divorce in Dubai. We both stay in Dubai. He claimed for custody of our 11-month-old twins. The divorce is because of domestic violence and interference by his mother.
I have had a history of epilepsy (a very rare occurrence) since 2011. I have been taking regular medication and working since 2011 as a teacher. The last time I had a seizure was in August 2023 when I was pregnant. No one was hurt although I fainted.
My husband is claiming for the custody on these grounds. I have been staying with my kids, all by myself for the past 2 months. My husband has left me and my kids and stays somewhere else.
I have worked in the US (2015-16) all by myself and have been working as a teacher in Dubai for 1.5 years. I have been driving in India since 2007 with no accidents or fines.
My epilepsy has never affected my profession or lifestyle. I have been to different countries all by myself.
Are there fair chances of me getting custody of my 11-month-old twins?

I purchased an apartment, but the previous landlord refuses to vacate. What to do? 0
Hello,
I bought an apartment, but the previous landlord is refusing to vacate it. The contract clearly states that the landlord should hand over the apartment on the day of the transfer.
Out of courtesy, I gave him three days to vacate so he could find a new place to stay, but the time has passed, and he is still refusing to vacate and hand it over.
What should I do in this case?

My hair was damaged by a very known and professional salon. Can I seek refund and compensation? 0
Hello.
I went to a very well-known and professional salon (or so I thought) for a normal hair dye. The guy who did my hair left the dye on my hair for over an hour when it was supposed to be on for a maximum of 30 minutes.
He wasn’t paying attention to me walking around the store talking to everyone and also doing another customer's extensions.
Now my hair is potentially damaged, my skull burns, and is flaky (meaning the dye wasn’t ammonia-free which is extremely unprofessional for such an expensive salon).
I didn’t even get the outcome that I wanted and the dye color doesn’t even show. I talked to him about it but he shut it down so fast and gaslit me the whole time and made me feel like I was the wrong one and I was ‘complaining about something so light’.
Please let me know what I can do legally about this.
Thank you.

View allHow to file an online defamation case from the Philippines against someone in Dubai? 0
Hello,
I'm currently looking for legal advice regarding an online defamation case. I am a Filipino citizen currently residing in the Philippines. The person I want to file a complaint against is also a Filipino citizen and is currently based in Dubai.
I have already sought legal consultation, but it cost me a lot for just a simple session. Unfortunately, I don’t think I can afford to proceed with the fees required for sending a warning or demand letter to the person I’m complaining about.
I would really appreciate any help, guidance, or information about possible free or low-cost legal services.
Thank you for your time!

What does Cabinet Resolution No. 1 of 2022 mean with exempting supervisory roles from the provisions of the Labour Law? 0
Dear colleagues,
According to Article 15 of Cabinet Resolution No. 1 of 2022 (“Executive Regulations”), employees occupying supervisory roles are exempt from the provisions of the Labour Law and the Executive Regulations in relation to maximum working hours only if they possess powers equivalent to those of the employer.
Could you please clarify what is meant by "if they possess powers equivalent to those of the employer"?
Currently, we have heads of departments who report to the directors. Will they be eligible for overtime?
Also, those who have a POA to sign contracts will they be eligible?
Or, those who temporarily replace the CEO while he is out, will they be eligible?

Can I request delaying my visa cancellation due to medical unfitness until I retake my medical test? 0
I got a work permit and moved to the UAE. I had a work permit for 2 months, which was supposed to be changed to residency. But I got medically unfit, and the company off-boarded me the same day.
They gave me a grace period of 15 days before cancelling the visa. In these 15 days, I have managed to get my test redone and am in the process now.
Can I ask my agency to let me stay till I get my reports updated, and not to cancel the visa as it's already in the legal limits?
I entered on 2 March, so my visa expired on 2 May. I have taken 1 test and the results are due by the next two weeks (between 14 April and 21 April).
Can I ask them to hold the cancellation because I am pretty sure my reports will be revised?
