إعفاء العامل الذي لديه حالة صحية من العمل خلال فترة الإخطار

مرحبا،

استقالت زوجتي أثناء فترة الحمل وكانت غير قادرة على العمل خلال فترة الإخطار بسبب تعقيدات خاصة بالحمل.

قام صاحب العمل بالخصم من مكافأة نهاية الخدمة الخاصة بها كجزاء لها بسبب تغيبها أيام الأجازة المرضية خلال فترة الإخطار.

تم الانتهاء من جميع الواجبات المتعلقة بالعمل وتسليم العمل، وكان صاحب العمل يدرك تماماً وضعها مع الحمل.

هل يمكن لصاحب العمل أن يفرض عليها جزاءً بسبب ذلك؟

If your wife has all the necessary medical reports to support her claim that there were indeed health issues caused by pregnancy that affected her notice period, then there are certainly grounds for complaining at MOHRE and contesting the gratuity dues.

Yes, we have.

It was also written on the sick leave certificates that the fetus was in danger and that she requires bed rest.

That was clearly conveyed to the higher management and the HR of the company.

So what do you propose? Should I try to explain this to the company before going to MOHRE?

Always best to resolve with the company first. MOHRE should be the logical next step if they refuse your arguments.
