Q: We are food bloggers and were invited by a restaurant to review their food. Once we arrived, the owner said she did not know of this. When we showed her the written confirmation from her husband she refused to accept it. They wasted our time and money, making us come all the way to her restaurant just to be told to get out. She was becoming hostile so my sister took out her phone to take a video of her screaming at us. But when the lady noticed the phone she attacked my sister. She pulled and scratched her very badly. She left a big mark on my sister’s arm. When the police came we were told to delete the video which we did in front of them itself. Once the police left, she threatened us that if we ever mention this to someone, post about it on Instagram, or leave a bad review on Zomato, that they will take us to court. Can she do this? I only want to write an honest review on Zomato where I explain our situation and post the pictures of my sisters arm. Or can she make a case on us?

س: السلام عليكم ورحمة الله وبركاته في سنة 2015 كانت ابنتي تعاني من حمى شديدة ودخلت علي أثرها مستشفى في دبي. وبعد 16 يوماً، تدهورت حالتها للأسوأ مما أدى إلى دخولها في غيبوبة وشلل حركي واضطرابات في المخ والأعصاب خلال تلك الفترة وتم تحويلها إلي لندن للعلاج. بدأت في التحسن نسبياً وتدهورت حالتها خارج البلاد ولكن لم أعرف سبب تدهور حالتها إلى هذا اليوم، والآن تم وقف علاجها في الخارج. للعلم بأنها أجرت 3 عمليات جراحية كبيرة في 10/1/2019 ولديها مراجعة في 10/6/2019 واللجنة الطبية ترفض استكمال علاجها في الخارج. السؤال، من الجهة المسؤولة عن الضرر الذي لحق بابنتي علماً بأنها كانت سليمة ودخلت المستشفى تمشي علي رجليها، والآن هي مشلولة حركياً؟ وهل هذا خطأ طبي أم لا؟ أفيدوني وجزاكم الله خيراً

Q: Good morning, I had two surgeries two years ago. After the first one, I needed to have another one based on lab results. After the second one, I developed severe complications (the doc briefly mentioned it on the consent and I signed it). I was misdiagnosed twice at ER at two different hospitals and was only diagnosed overseas while on holiday. I required surgery, however, it didn’t help and two months later I had another surgery in Dubai. Again it was unsuccessful and I had another surgery two months later. This year I had another surgery. The complication from the original surgery is severe and lifelong and I’m facing so many difficulties. Every doctor I saw after that said they did a very bad job and it’s extremely hard to fix it. Lab results from the original surgery say that all the tissue they removed was healthy and nothing was found. However, the doctor removed a big part and now I’m facing problems. I need an advice if I should file a formal complaint with the authorities. Thank you

Medical treatment provided to patients does not always achieve the desired results, and sometimes it may lead to catastrophic consequences that cannot be remedied. This is due to several factors, some of these factors are related to the therapist or to the patient himself, or even related to God's will. It was, therefore, necessary for the legislator to intervene and develop the laws governing medical malpractice cases and set the limitations of liability for the therapist in such cases.

The Law sets up the legal framework for the protection of consumer rights in the UAE. The Law establishes the Higher Committee for Consumer Protection and the Consumer Protection Department, and sets up the fines for breach of its provisions.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
