Q: I registered a Performance Order lawsuit. I received a decision in my favour.
The respondent received a notice to register an appeal within 15 days. The 15 days have elapsed. What is the next step to register an execution case?
There is no judgement in the file, only the decision obliging the respondent to pay and then the decision that respondent has 15 days to file an appeal.
Should I make a petition for "Executive Writ" now or register an execution case directly?

How to file a performance order lawsuit against a company and its managers?

Q: A civil company that I had dealings with has 2 partners. Each partner is also the manager of the company.
The civil company had sent me a statement of account and a letter acknowledging a debt. They confirmed in writing that they will pay me AED 153,500 on 10th September 2021.
The letter is on the company's letterhead and has the sign of one of the two managers/partners of the company.
They did not pay me till now.
I wish to register a Payment Order/Performance Order (Amr Al Arida) lawsuit against the company since my right is unconditionally confirmed in writing.
QUESTION: Should I make the lawsuit only against the civil company as respondent, or should I also mention the two managers/partners as respondents i.e. a total of 3 respondents?
Please guide me.

How to serve a notice of writ and obligation to pay when the debtor is unreachable?

Q: Dear Lawyers,
I have initiated an execution case against a debtor. As the first step, I sent a "notice of writ and obligation to pay" to the debtor's advocate. The advocate refused to accept the notice.
Then I tried to send an email and SMS to the debtor. However, the court system said "No email found on Emirates ID" and "System refused to send SMS" because the debtor has outdated information on their Emirates ID.
Question 1: Is a notice considered served 7 days after the court issues it, or 7 days after the debtor receives it?
Question 2: What is the next step if email, SMS, and physical delivery to the advocate fail? I do not have the debtor's physical address.
2.1 Is there a system to publish the notice on the court website? How do I petition for this?
2.2 Can I petition to publish it in a newspaper? How do I petition for this?
2.3 Are there any other steps I should take to notify the debtor?

Can an appeal be rejected even if it is filed within 30 days from the date of the Court of First Instance judgment?

Q: Could you clarify if an appeal must be filed within 30 days from the date of the Court of First Instance judgment?
However, according to Article 166, paragraphs one and two of the UAE Civil Procedure Law No. 42 of 2022, is it possible for an appeal to be deemed inadmissible even if it is submitted within this 30-day period if the appellant fails to present the grounds for the appeal before or by the time of the first hearing at the Court of Appeal?
