Can an appeal be rejected even if it is filed within 30 days from the date of the Court of First Instance judgment?

Could you clarify if an appeal must be filed within 30 days from the date of the Court of First Instance judgment?

However, according to Article 166, paragraphs one and two of the UAE Civil Procedure Law No. 42 of 2022, is it possible for an appeal to be deemed inadmissible even if it is submitted within this 30-day period if the appellant fails to present the grounds for the appeal before or by the time of the first hearing at the Court of Appeal?

Welcome.

According to Article 166 of the UAE Civil Procedures No. 42 Resolution 2022, the achievement must be submitted within 30 days from the date of the judgment of the Court of First Instance.

However, even if the waiver is submitted within this period, it may be possible that it will not be approved if the attendant does not provide some reasons before or on the first date of providing assistance.

Therefore, it is important to provide assistance in a timely manner to help in the provision of assistance by the court.

Yes, the UAE Civil Procedures Law requires that an appeal be filed within 30 days from the date of the judgment of the Court of First Instance.

However, according to Article 166, paragraphs 1 and 2 of the Civil Procedures Law No. 42 of 2022, an appeal may be deemed inadmissible if the appellant fails to submit the grounds for the appeal before or on the date of the first hearing before the Court of Appeal.

In other words, filing an appeal on time is a necessary first step but is not sufficient on its own to ensure that the appeal is accepted.

The appellant must also submit the grounds for the appeal by the date of the first hearing, otherwise, the appeal may be deemed inadmissible.

Yes, under Article 166 of the UAE Civil Procedure Law No. 42 of 2022, an appeal must be filed within 30 days from the date of the Court of First Instance judgment.

However, it's crucial that the appellant presents the grounds for the appeal either before or by the time of the first hearing at the Court of Appeal.

Failure to do so can result in the appeal being deemed inadmissible, even if it was submitted within the 30-day period.

This requirement ensures that the appellate process is conducted efficiently and that all parties are adequately informed of the issues under appeal.

Therefore, timely submission of the appeal grounds is essential to maintain the admissibility of the appeal.

If you need further assistance or wish to discuss this matter in more detail, please feel free to contact me via WhatsApp or phone.
