Arbitrary dismissal for requesting the payment of delayed salaries

Dear Ma'am

Good day to you,

I am working in a company where they didn't pay me for 5 months and I have asked them to do so, in order to leave for marriage on August 26, 2018 (Please note my visa expires on 18/09/2018).

But the response from them was swift and fast and they gave me a letter of termination with notice period 30 days. I have refused to sign the letter.

The company is not in a position to settle my outstanding salary gratuity and leave salary at the moment, as I have been informed so verbally.

So shall I file a case and tell the labour office to hold it till I come back from my marriage, one day before my visa expires? is that possible?

Dear Dima,

As I understand from your query, you have a very strong and legit case against your employer.

You are eligible to get your 5 months salary, salary for the notice period, gratuity and salary for leaves if any.

Additionally, you may also claim for compensation for arbitrary termination (up to 3 month's salary).

Since you have your wedding in August 2018, I suggest you issue a Power of Attorney and leave for your wedding. The Power of Attorney holder can file a labour case on your behalf.

I wouldn't recommend you delaying the labour case as there is a possibility that the management of the company may abscond and leave the country (since you have stated they are not in a position to make payments towards salary).

Dear Hari,

Thanks for your clear answer.

Is that possible to appoint an attorney, as you have mentioned, and request the court to cancel my employment contract so I can come again with visit visa as willingly the employer can't do it?

If I am outside the country and my visa expires, is that possible to automatically come with a visit visa?

Dear Dima,

Firstly, try to persuade the employer to cancel your employment visa, if not then.

Secondly, You will have to proceed to Tahseel Center and raise a labour dispute with the employer, and the centre will issue a notice and try to amicably settle the dispute between the parties.

If there is no settlement then the matter will proceed to Court.

Thirdly, If the employer cancels your visa, then you can leave the country (and visit back on a visit visa) and we can file the labour case on your behalf.

Note: There is no provision whereby the employee can cancel his visa. This needs to be done through the employer or the Court.
