Q: Dear questioner,
My father (Muslim) has passed away in South Africa. He leaves behind 4 children, his wife (our mother) and his own mother.
He had a will for South Africa in which, I (oldest son) am executor. The will does state that it encompasses all property and assets wherever they may be.
He has various properties and assets in the UAE. My questions are:
1. Does his will have power in the UAE or will it be divided by Sharia?
2. What documents are required to wind up his estate?
3. What is the wind-up process within the UAE?

Q: Good day,
My friend now is facing some difficulties to get part of a property located in Dubai. She is a citizen of a Central Asian country and her husband is a citizen of Yemen.
They got married in a registry office in Dubai. He had died some time ago and there is no will left. He used to have 2 more wives and children from these wives.
My friend (his 3rd wife) wants to get some part of the property located in Dubai. Her husband used to have a residence in the UAE as an investor.
Can you please assist whether she can claim for the part of this property (both of them are not citizens of the UAE)?
If yes, is it possible to explain in brief the procedure?
If no, can she obtain a decision from the Court from her country of residence on the division of the property located in Dubai and later enforce this decision in Dubai?
Then will the court of Dubai recognize and enforce this decision of the Civil Court of the foreign country?

My tenant was not paying rent, so I filed a case and won it. The court has given a bailiff eviction date of 7th July. The tenant also has outstanding rent plus court fees to pay.
The tenant called me and proposed an out-of-court settlement. She is offering to hand over the keys today, along with her furniture, to compensate for the outstanding rent.
I don't trust the tenant as she has lied many times. She's asking me to come visit the apartment to look at the furniture and take the keys.
1. Please advise if it's ok to visit the apartment and take the keys and furniture without involving the bailiff. Do I need to report the furniture adjustment against the rent due to the court?

4. Can I write down the settlement with her on a plain piece of paper with her signature?

Hello,
A customer based in Dubai booked a public experience online on the website of a reputable business based in Dubai.
The customer came to the business location, the team was ready to provide the experience as per her booking.
The customer started to shout loudly, claiming that she was expecting a private experience. She refused to do the experience and left. Then she started calling the Management claiming a refund.
The Management explained that as per the T&Cs, experiences booked online are public. The Management offered as a goodwill gesture to refund the customer after deducting the cost of preparations that were paid by the business to set up the experience. The customer refused.
The customer used her Instagram account and as an influencer + Google review to launch a campaign against the business reputation, inciting her audience/people not to use the business services. She used signs of alert/warnings.
Is there a law that punishes such public incitement in the UAE?

How long does it take for a bounced cheque case to be closed after a settlement? 0
Hello,
I had a cheque bounce case filed against me in Dubai, but I’ve now settled it with the complainant. The case has been with the Public Prosecution, and I’ve already submitted the notarized settlement documents.
It’s been 5 days since submission, and when I checked with the legal team, they couldn’t give me a clear timeline on how long it might take for the case to be withdrawn and for me to receive clearance.
Does anyone here have experience with this process? How long did it take for your case to be closed after submitting the notarized withdrawal request? Should I expect it to be done in a few days, or could it take longer?

I am from India and in Sep 2018, I purchased an apartment in a hotel. The hotel has not been completed and the delay is more than a year.
They have not paid any compensation as per the contract, nor do they talk about it. I have paid more than 80% in installments and paying it regularly.

My uncle died 2 weeks ago in one of the private hospitals here in Dubai.
We have already completed everything regarding the repatriation of his body with the help of his employer and his remains are already sent back to our home country last week.
He used to give me an access of his ATM card before and I tried to access it just few days ago and I found out that there is some amount of money left on his bank account.
I am aware that he has some pending bank loan requests before he died, so I am afraid that amount might be the reason of such big amount.
Being the only family member of my deceased uncle, what should I do in order to make sure that the amount is from his savings and not from his bank loans?
In case the amount is proved to be his own savings, is there any chance for me to get the authorization to claim that amount from the bank to be used by his family?
He has a wife with 3 kids back home.

Hi,
I purchased an off-plan apartment in Dubai in 2017 from one of the projects in Dubai.
I was told that the handover is going to be in Q2 of 2019, until now, the apartment has not been handed over. During the delay, the developer has never communicated pertaining to the delay.
I have already paid 50% of the total value plus the DLD fees. As per Dubai [----], the project progress stands at 67%. Now, I need guidance and advice from a legal point of view.
What are my chances to recover my money from the developer?
If I go through a lawyer, is it possible to recover all the money I have paid?
Is there anything I can do to recover my money?

Even though the old owner gave the tenant a 90-day notice about the new rent, the tenant is not agreeing to the notice because it didn't come from us.

What can I do if a company hired me then changed their mind? 0
I am working in a company and their management is the worst. They made an interview in India and called me.
After calling me here, they again made interviews and made me work for 1 month. And now, they're telling me I am not capable of work and they are mentally torturing me.

X Real Estate LLC is a newly formed LLC company in the mainland (DED) with 10 partners, 9 of them Indians and one Pakistani.
As per the new provisions, the company is owned 100 % by expatriate residents. The company’s business is buying and selling real estate in the UAE.
Query:
What happens to the company and other partners, when one partner dies with or without a will?
Can the remaining partners continue to operate the bank account or it will be frozen?
Are the operations of the company frozen? Can the remaining partners carry on the business as usual, buy, rent, and sell the properties?
Can the partners pay the share of the deceased partner to his legal heirs and distribute his share among the remaining partners?
Will this affect the other businesses of the remaining 9 partners in any way?
