Questions & Answers
My employer has not issued my residence visa yet and I am in overstay. What can I do?
I came on an E-visa (employment visa) from Uganda to the UAE, and my employer didn't make my residence visa. Now I have been in overstay for 24 days.
What should I do?
Dear Inquirer,
Thank you for reaching out.
If you entered the UAE on an employment visa and your employer failed to process your residence visa, resulting in overstay, you may have legal grounds to file a complaint against the employer and apply for a status correction.
To avoid further penalties and explore the best legal solution for your case, we recommend booking a legal consultation or authorizing our office to represent you.

If you exceed the grace period specified in your e-work visa by more than 24 days, you may face fines.
Therefore, you should visit the nearest Amer Center or one of the General Directorate of Residency and Foreigners Affairs' service centers to resolve your legal status before the problem escalates.
You can also contact your sponsor (employer) to resolve the issue.
Dear Questioner,
Thank you for reaching out.
If you entered the UAE on an employment entry permit (e-visa) and your employer failed to complete your residency (Emirates ID and visa stamping) within the allowed period, you may now be considered overstaying.
Here’s what you can do:
Contact the Employer Immediately
Your employer is legally responsible for completing your visa process within the permitted timeframe (usually 60 days from entry). You should formally notify them in writing to fulfill their obligation and regularize your visa.
Check Your Overstay Fines
You can check your overstay fines through the ICP website or app using your passport number. These fines typically accrue daily.
File a Complaint
If your employer refuses to process your visa or resolve the issue, you have the right to file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).
If you're employed in a free zone, you may file a complaint with the relevant free zone authority.
Exit or Regularize Status
If the issue is not resolved soon, you may need to either exit the country and re-enter on a new visa or apply for status correction through immigration.
Let us know if you'd like assistance in filing a complaint or communicating formally with your employer.
Best regards,

Dear questioner
If the employer is not making residence visa then ask them to cancel the visa or file a complaint in MOHRE, once after the same take a new visa or exit legally to avoid visa violations which may restrict your visit in UAE for future.
