Q: Good evening,
My name is Dr Randeep Singla.
I joined one hospital in Abu Dhabi in November 2016. Due to some family crisis, I had to leave my job one month after and came back to India without visa cancellation.
The employer threatened me with an absconding case at that time. Since 2016 I have not travelled to the UAE.
Currently, I have another job offer from the UAE and want to pursue it.
Is it possible to check for labour ban or blacklist status before I apply for my next visa?
Kind regards,
Dr R. S.

Travel status of an employee after leaving work without cancellation

Q: Hi
I have been working with Emirates Airlines for almost 9 years, and due to some emergency reason, I left Dubai going back home.
After that, I sent my resignation by email. My employer said that they need my passport to cancel my residence visa otherwise I will be blacklisted by the UAE immigration.
This case has been almost seven months ago. If I decided to come back to Dubai, how to issue tourist visa with no issue or being refused?
Do I have to pay a penalty?
How to remove the ban or blacklist?
Will they arrest me at the airport?
Warm regards,
Tony

Apprehension of immigration fine before returning to the UAE

Q: My brother went to Dubai on a visit visa and applied for a work visa and he got his work permit, but he came back to India during his visit visa (before work permit start) and never gone back.
His employer cancelled his visa and we have the documents (The employer is one of our relatives, he didn't report anything wrong to immigration).
Recently, my brother applied for a visit visa and he got rejected and then we informed the employer and they cleared from Immigration. Now, we reapplied for the visit visa and we got it.
My question is , although we got the visa, our fear is maybe my brother gets fine when he comes to Dubai because he never informed immigration that he is not coming back to Dubai for work (we have the proper work permit cancellation document and visit visa).
What should we do?

The consequences of leaving Dubai with a pending visa cancellation

2
Q: Dear Sir/Madam,
I am currently holding a visa to change status from a tourist visa to an employment visa.
However, I have decided to go back home before it expires as I am facing financial difficulty even with my current employment.
My employer is saying that I cannot leave without canceling the visa.
What will be the consequences if I leave Dubai before the cancellation takes place?

Is overtime applicable on work-from-home days under company’s policy? 0
Hello,
The company has a policy allowing employees to work from home once per week.
Now, employees are asking if overtime is applicable for those who work from home as well.
Could you please clarify?
Thank you!

Can the employer force the housmaid to work for unlimited hours without rest? 0
Hi
I'm a nanny, and at the same time, I work as a housemaid (khadama) here in the house. I work, but as I know, the nannies and housemaids have different rights, and my employer doesn't give me rest.
My work starts at 7:30 am and then finishes at 10 pm or less. It depends on whether the baby is asleep or what time they will take on me if not yet asleep. Is this right?
Also, at the time of eating, I'm still working because the baby is with me, so I just let her sit in her chair. That's how I eat.
Please answer me. I want to know my rights.
Because if I can leave during the 6-month probation, I want to take it if the employer is this kind. I don't know.
They are also expats, but they don't follow the rules of the UAE regarding a housemaid.

My previous organization has not yet released EOSB because I contacted a client. Is this legal? 0
I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

Can I renew my trade license and visa if I have multiple cheque execution cases filed against me? 0
Hello,
I have multiple cheque execution cases filed against me due to financial strains last year.
My trade license and visa will expire next month, along with my Emirates ID.
Is it possible for me to renew my license and visa along with EID prior to settling the execution cases?
The trade license and visa were issued by the free zone authority.
I look forward to your response.
Thanks.

How to file a case against my former company for unpaid salary I was not on their visa? 0
Dear Legal Advice Middle East,
I hope you are well.
I am seeking legal advice regarding an unpaid salary issue with my former employer, [-----]2 LLC. I was employed with them from December 4, 2024, to January 7, 2025, on a monthly salary of 5,000 AED.
However, I only received a partial payment of 2,473 AED on February 24, 2025. The remaining 2,527 AED is still unpaid.
I submitted a complaint to MOHRE on March 2, 2025, but I am unable to proceed further through their official channels.
This is because I was working under the visa of my previous employer, [---] LLC, and not under [----]’s sponsorship.
As a result, I do not meet the criteria to file a labor complaint via the MOHRE app or hotline.
Given this situation, I would appreciate your guidance on how I can legally pursue the recovery of my remaining salary, considering the complications related to my visa status during the employment.
