Q: Dear Sir, I am an Endodontist Dentist from India. I got offer letter on 29 July 2016. The HAAD licence for a specialist dentist was complete on 14 October 2016.
I contacted my employer regarding employment visa but every time he gave me an excuse! Now is 23 January 2017 till now there is no proper response from the employer about the employment visa.
How should I move out of the situation? What legal procedures can I follow so that the employer either get me employment visa or let me move out to search any other job without getting work ban?
Kindly help me in the situation.

What to do if your new employer withdrew the employment offer

Q: I got an employment offer from one of the construction companies from Dubai after the personal interview. I signed the employment offer which I received through email and sent back.
Now, after 20 days, they withdrew this offer as per their management decision. I am working in Qatar and I already resigned from my job, and next week I have to leave Qatar.
I don't know what to do. Is there any chance to claim it legally?

Q: Sir,
I am currently in India. An offer letter was sent to me by an employer and I have signed it.
Later, I came to know that this company tortures the workers and even salaries are not paid in time. I am scared.
A week ago, they sent me an email asking me to sign "prerequisite for the issuance of work permit", which I have not yet responded.
Will I have to face a ban if I do not sign it? Can they issue a visa for me without me signing it?
Please help me.

Is employment offer (LOI) a legally binding document?

Q: I'm a German national who got an offer for a job in JAFZ, which I subsequently accepted by signing an "Employment LOI" starting 09.04.17.
On 10.05.17 the LOI was revoked because my work permit got rejected by the DNRD. The reason for rejection was not given and I was told by company's PRO that I'm not allowed in Dubai. I have never been in Dubai before the rejection.
I contacted JAFZA and found out that the PRO made mistakes in submitting the application. A company letter was requested and was never provided.
The PRO convinced the company that my father's religion "Shiite" and my birthplace "Lebanon" is the problem. I was then told by the PRO that I'm not allowed to enter Dubai. I was able to enter on 15.05.17 without any problems.
1. Is the LOI legally binding? It does not state any conditions concerning the visa.
2. Can I sue the company under the anti-discrimination law and demand compensation?
3. Can I find out why DNRD rejected the application as the company is refusing to ask for clarification?

What to do if your former employer owes you money

Q: Assalamu alaikum,
My name is Mohammed Yaseen. My concern is that my previous employer was supposed to pay me AED 3700 of my salary which is pending for one year, and I have been asking him for 6 months.
Actually, he was supposed to pay me AED 11700 after the cancellation of my contract, after cancellation he paid me AED 8000 but AED 3700 is still pending.
I couldn't do anything before the cancellation because I had to move to another company as the other company will not wait for me. So, on a mutual understanding, I cancelled the contract.
He also committed as documented in my official email address that he will pay me all amount, but now he isn't receiving my calls. I have the email, WhatsApp messages...etc as a proof.
What can I do now to get my money back? Please suggest.
I lost my patience, since 6 months I have been asking him. Please help. Appreciate any help provided.

Q: I am Jasim. I filed one case against the company in Dubai Court in commercial dispute category.
The company offered me a good position and told me to resign from the previous employer and at last, they sent me the visit visa and told me to join the company. They informed me they started my visa processing.
After working for 2 months I did not get my salary and I came to know I was cheated and they had no visa quota due to pending salaries to the employees.
Now I am in the 5th hearing stage in the Dubai Court chamber. Now, the judge informed me that my case will be rejected if I do not submit a case transfer paper from the Ministry of Labour Court to Dubai Court.
What I have to do now? I had no visa to start the case in Labour Court. I went there first, but they told me to go to Dubai Court since I was on visiting visa.

Claiming labor entitlements from employer without employment visa

Q: I am an expatriate from India. I have received an appointment from my employer in April 2018 with an appointment letter as Sales Account Manager.
The employer told me he will bring me to Dubai with a visit visa and then apply for employment visa when I start working.
I joined the company on April 24th 2018 in Dubai and worked for 3 months and no employment visa applied by the employer for me.
I generated business from customers from the market as per my job responsibility.
As my visit visa expiry was due on July 22nd 2018, on July 20th 2018 I exit the country to India on their direction and came back again on a visit visa with the assurance of employment visa.
Now, the company is not paying me the salary as mentioned in the appointment letter. I am working for the company without being paid any money.
I feel that my position has been exploited by the organization for my blind faith in them.
Is there any way I can claim salary from the employer legally, as I am working for the company?

Claiming unpaid salaries from employer without work visa

Q: I overstayed in Dubai just because of my ex-employer negligence, after failing to proceed my visa stamping on my passport.
My ex-employer issued only a pink copy visa for me. Although I had informed my ex-employer that time was too short and begged to complete the visa process, but unfortunately, he could not do so.
My 10 months' salary is also pending at their side, so I don't have money to pay off my immigration overstay fine. But in spite of all the hardship, I went to the immigration department at Al Aweer to waive off my fine.
I was trying to avail any sort of discount to clear my overstay status, but the immigration department did not listen to my full stance and sent me to the temporary immigration department, and gave me 2 days to arrange AED 20000 as my fine.
I said to them I have only AED 10,000 and they refused to take it. Now, my previous company paid the fine.
Just let me know if I can come back to Dubai and if there's any chance to recover my pending salary.

Contractual rights of a former employee 0
I resigned from my position in October 2016. The company is threatening legal action for soliciting employees and starting my own business to compete with them. All false allegations.
I have responded to their lawyers already but I wanted to know if I have a case against them as not all my contractual rights were honoured.

Dear Sir/ Mam,
I am staying in Sharjah. We stayed in the same flat for the last 2 years. Our contract is ended on May 5th. But as we are migrating to another country we requested our landlord to stay here till June end 2 months back. He agreed to the same at that time.
Now he is asking to give 3 months more rent from June as a penalty to settle the things. Our contract already finished now.
