How to sue your employer if you don't have the labour contract

I am Jasim. I filed one case against the company in Dubai Court in commercial dispute category.

The company offered me a good position and told me to resign from the previous employer and at last, they sent me the visit visa and told me to join the company. They informed me they started my visa processing.

After working for 2 months I did not get my salary and I came to know I was cheated and they had no visa quota due to pending salaries to the employees.

Now I am in the 5th hearing stage in the Dubai Court chamber. Now, the judge informed me that my case will be rejected if I do not submit a case transfer paper from the Ministry of Labour Court to Dubai Court.

What I have to do now? I had no visa to start the case in Labour Court. I went there first, but they told me to go to Dubai Court since I was on visiting visa.

You should have initiated a case against the company for fraud. Dear, we need to review the documents in order to understand the case.

In order to file a case against the employer, transfer letter from Ministry of Labor is compulsory.

Why should I open a case against a company for fraud? What is the logic in it, Dear?

I have proof for all my service. The company told me that my visa is under processing and for their fast track project I have to start working. I trusted the company and started working.

Nobody informed me about this transfer letter for these last 4 months case time. Now the judge told me that he wants this transfer letter to proceed my case. Otherwise case will be rejected.

When I went to labour court before opening the case in the Dubai Court, they told me that I cannot open a case in the Labour Court since I did not have labour visa. I am on a visit visa. The company cheated me here.

What should I do, Dear? Any lawpoint or chance to proceed the case.
