Q: I am the buyer of a property and I signed MOU with an agency.
One of the MOU clauses was “if the property valuation is less than the selling price, then the MOU is null and void”.
The valuation came less than selling price and the agency is refusing to give the cheque back.
What can I do?

Q: Dear sir/madam,
I signed an MOU to purchase a property. The MOU was signed by the POA holder of the seller on hard paper. We have been following up with the seller agent and he was keeping us up to date for nearly a month that the NOC is in progress.
Last week when the MOU period expired, the agent informed us that the POA issuer has decided not to sell as he has another offer. I asked the agent about the MOU and the agent said MOU has no value as it is on paper and not in the Dubai Rest application.
Questions:
Can I enforce a paper-based MOU (Form F)? Or due to new rules, it is no longer valid and we made a mistake?
The MOU was for one month and it is about six weeks since we signed the MOU.
Appreciate any advice!

Getting a higher offer for selling a property after signing an MOU. What to do?

Q: Dear sir/madam,
I wanted to sell my property. I signed an MOU and the buyer paid a deposit. I got a higher offer for my property and the agent is saying that he will block the property if I do not obtain an NOC.
The MOU runs out in 5 days. Will I have to pay a penalty? Or can I just let the MOU expire as it is not attested?

I signed a Memorandum of Understanding (MOU), but the buyer has not given a security deposit or signed it yet. I received another offer.
Since I signed only a hard copy (not online), can I sign another MOU as the buyer has not replied?

Q: Dear Sir/Madam,
I've signed an MOU for a townhouse, and the seller has signed it as well. Now the seller is backing out, saying that the agent gave him wrong information and he doesn't want to sell.
This is after more than a week of signing the MOU. Clearly, he is getting a better offer. But as a buyer, what are my options?
I've already lost valuable time, and it's causing me a lot of mental stress.

I have signed Form F and got the mortgage but the seller is in breach. What to do?

I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?

We signed an MOU and it expired before the developer granted NOC. Can we refuse to extend?

Q: We signed an MOU in December'23 and it expired on the 9th of Feb.
The buyer has got the manager's cheque ready but there is a long delay from the developer's end in issuing the NOC.
We are getting better offers now for our property and we don't want to extend the contract.
Can we do that or we cannot refuse to extend?

Q: Dear Sir/Madam,
I have signed an MOU to buy a property. The MOU says that the property will be vacant on transfer. The current owner had given a 12-month notice to the tenant but the tenant is refusing to vacate.
The owner has filed a case with RDC and the hearing date is also given. I worry that the tenant may not show up for the hearing and the hearing will be postponed beyond the MOU date.
What are my options? Can I terminate the MOU and penalize the owner, or do I have to proceed with the property transfer regardless of the tenant leaving?

I signed From F for a property purchase with promise on extension but it was rejected. What to do?

Q: I made an offer and signed Form F for a property purchase. My decision was based on the property assessment as an End Unit and its capacity to extend the living room to my requirements.
The two agents (buyer and seller both from the same agency) confirmed that a living room extension was possible at a fee payable to Emaar. I was ok with the fee. I made an offer based on this information and signed the Form "F" prepared by the agents.
Later upon receiving the CAD drawings, it was noted that Emaar would not give NOC as the living room walls were structural. I am an end user and I can't accept this unit for the rest of my life as it doesn't meet my needs.
I want to get out of this Form "F" as my agent misled me (doesn't matter if intentionally or unintentionally). The problem is agent is rewarded 2% for misleading me and I am facing a penalty of 10%. it is only 3 weeks into the deal and 5 weeks till signature.
Can I get out of this legally and agent find a new buyer for the seller?

Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

The ownership of a code of a web application 0
Hello,
I represent a tech-based marketplace company registered in a Freezone, in the UAE.
This is in regards to the UAE's law regarding the ownership of code when there is no clause mentioned in the agreement. One of our products (web application) is being developed by an agency in the UAE.
While we do have agreements in place, there is no clause regarding ownership of code. In the situation mentioned above, I've heard that the ownership of code either goes to the author or the agency that employed the author. Is this true?

I have rental disputes and got a settlement plan 8 months ago.
But I did not pay the settlement because at the moment of applying for the settlement plan, I had a job offer and lost it because of the travel ban and the visa could not be processed.
I have another personal police case where I already paid an amount of 18,000 and the claim was 40,000 dirhams. Now that I did not continue paying, the plaintiff put the case again.

I bought a new vehicle from the dealership [-----] and after 5 min of using the car, an alert popped up. Less than 24h later I informed the dealers of the issue.
After struggling with them about it, I finally brought the car to service at their company and they have confirmed the part needs to be fully changed.

How to know the judgment when the portal says "decided"? 0
Dear sir/madam,
There is a case against me in a commercial, full-jurisdiction court. Sorry if I'm getting this wrong. I have not participated in the case and on the advice of my UK lawyers, I have not been represented there in Dubai.
Upon checking the portal, it says a judgment was reached yesterday, but I can't see further details. So my questions are:
1) Do judgments happen behind closed doors or in front of the lawyers? (the plaintiffs have lawyers)
2) How long does it usually take for the verdict to be public and for me to see the outcome of the case?
The only thing it says online is the word "decided".

I got deported from the UAE for failing medical but when I reached my country, I have done several medical checkups but everything is OK; HIV negative, no hepatitis B, etc.
I don't know if there was a mistake or a misfortune for me. I am wondering if they can allow me to come back to Dubai.

Respected Advisors,
I have been involved in a few criminal cases since 2017, but all of them were cleared by this year. I have obtained release letters for all the cases from the public prosecution office through an online portal.
Recently, I also received my residence visa. After the visa process was completed, I applied for a PCC online. However, the request was rejected.
I contacted the 901 office, and they advised me to visit the CID. I arranged for a power of attorney to be granted along with all the necessary documents to update the system.
Twice I was told to come in person, but I am hesitant to do so because of my previous negative experience.
Could someone please advise me whether I must go in person or if the person holding the power of attorney can handle the process?
