How to get the settlement after the issuance of the final judgment?

Q: Dear Sir/Ma'am,
I have a labor case and the final judgment was declared in my favor. The settlement is not done yet. I opened an execution file through the typing center.
As per the ministry, I had canceled my visa and work permit after getting the judgment. I need your advice as I don't know the further procedures and how long I have to wait to get the settlement. I'm in a grace period now and it will expire next week.
From the typing center, they asked me to call the Tableegh center to get the notification. I don't know what procedures are going on. How long I have to wait to get the settlement?
I know that overstaying will be fined. Do I need to exit or renew my visa? I'm jobless now. Why they are telling me to call Tableegh center?
Why it is getting delayed if the judgment is already declared? The company is still opened. They can pay for my settlement. To whom I approach to help me to get the settlement asap? I hope you will reply to me with the right information to help me out with this issue.

How to convince the execution judge to put a travel ban on company manager?

Q: Is it possible to put a travel ban on the manager of a debtor company in a civil execution lawsuit?
I asked for a travel ban on the manager of a company.
The judge refused because the identity of the manager was not declared in the trade license (But it shows in the company MOA and some final verdicts issued by the court).
I then filed a grievance against the execution decision.
But the grievance verdict was that I cannot pursue a manager to pay unless I prove mistake, fraud or deception by the manager.
So, is it still possible to put a travel ban or detention on the company manager due to the default of payment of the company, even without proving any mistake, fraud or deception of the manager?
Ref Article 186 of Cabinet Decision No. 57 On The Implementing Regulation Of Federal Law No. (11) Of 1992 On The Civil Procedure Law. The law allows travel ban/detention of any legal representative.

How to claim a debt from a civil company after filing the execution?

Q: I won a civil court case against a civil company with a professional license (Not an LLC company). I started an execution case for AED 262,800.
One of the partners of the civil company informed me that his company will file for bankruptcy and I will not get any money at all.
He said that all the company debts will be wiped away and he will not get a jail term and he will not have to pay anything.
Article (671) of Civil Transactions Law regarding civil companies states that partners have to pay the debts of the company.
(A) Which view is legally correct? Is it possible to demand money directly from the partners of a civil company after the company is declared bankrupt?
(B) How should I protect my rights if the debtor Civil company files for bankruptcy?
(Important Question C) Will the court automatically distribute the debt of the civil company to its partners upon declaration of bankruptcy? Or do I have to start a new court case against the partners after the civil company is declared bankrupt?

The defendant hasn't paid despite the court order. How to recover my money?

Q: Dear Sir/Madam,
As the plaintiff, I filed a case in Dubai Courts through AL ADHEED regarding a bounced cheque. The court issued an order instructing the defendant to clear the payment by December 25, 2023.
However, the defendant has not honored the judgment, and the payment remains unpaid.I received advice from the representative at AL ADHEED that my next step could be to request the blockage of their trade license.
However, I am unsure if this action will assist me in recovering my money.
Can you please advise on the appropriate next step for me to take in order to recover the money?

I'm a tenant of an apartment and a new owner has purchased the apartment. I would like to know:
1. Should I revise the Ejari by canceling the previous one and applying for a new one?
2. My current rent is 35% less than the current market value. Can the new owner change the rent as per the market value, or he still has to follow the RERA Index calculator for a new contract?

I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24.
The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court.
He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true?
The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment).
We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires.
Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

I have signed Form F and got the mortgage but the seller is in breach. What to do? 0
Hi
I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?
