Questions & Answers
The defendant hasn't paid despite the court order. How to recover my money?
Dear Sir/Madam,
As the plaintiff, I filed a case in Dubai Courts through AL ADHEED regarding a bounced cheque. The court issued an order instructing the defendant to clear the payment by December 25, 2023.
However, the defendant has not honored the judgment, and the payment remains unpaid.I received advice from the representative at AL ADHEED that my next step could be to request the blockage of their trade license.
However, I am unsure if this action will assist me in recovering my money.
Can you please advise on the appropriate next step for me to take in order to recover the money?

Dear Questioner,
Continue filing requests with the court to pressure the person to hand over money to you; there is no other way than that.

Greetings,
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
To recover your money from the defendant who hasn't honored the court judgment, follow these steps:
Request execution of the judgment through the Dubai Courts' Execution Department. They may seize assets, freeze bank accounts, or attach assets to satisfy the judgment.
While you can request to block the defendant's trade license, it doesn't guarantee immediate payment.
Consult with us for guidance throughout the process to increase your chances of successful recovery.

Dear Questioner,
Yes, you have options to request to block their trade license and company bank accounts and can impose a travel ban as well.
These will force him to pay, directly linked to his transactions.
If you need further clarification, we will arrange a legal consultation session for a charge.

Dear Questioner,
In such circumstances, you should follow the execution procedures of the court. The Execution Department at the court where the judgment was issued is responsible for enforcing it.
Submit the order along with any necessary documents (such as the bounced cheque) to initiate the enforcement process.
The enforcement department can take various actions to recover the debt, such as seizing the defendant's assets, attaching bank accounts, or garnishing their salary.
Thank you for reaching out regarding your case related to the bounced cheque issue!
I understand the urgency and frustration that can arise when a court order is not promptly honored. In such situations, it's crucial to take strategic steps to enforce the judgment and recover the outstanding amount.
Given the circumstances, the advice you received about requesting the blockage of the defendant's trade license is indeed a viable next step.
Blocking their trade license can exert pressure on the defendant to comply with the court's order, as it directly impacts their ability to conduct business.
To proceed with this course of action, I recommend initiating the process to block the defendant's trade license as soon as possible.
Additionally, it may be prudent to explore other enforcement measures, such as seizing assets or initiating legal actions that can further compel the defendant to fulfill their financial obligation.
