Q: Obtaining a refund from the developer: I bought an off-plan apartment a long time ago and paid around 70 % of the deposit. The apartment was supposed to be ready by 2009 but it is not still ready. Around 2016 the developer changed and then we've been told that the project will be finished by 2020. Now, the second developer says that the project might be ready by 2024. I want to cancel my contract and get back my money. The second developer told me the first one is responsible for the project and they don't even answer my emails. I have a couple of questions: First of all, I wanted to know if I can terminate my contract, and if so, how can I do it and how long will it take? Thank you

Q: I have booked a unit under construction with a developer 3 years ago. I paid 30% during construction and 70% was due since Jan this year. When I booked the unit, my plan was to get financing from a bank to cover 70% payment because I was working with a semi-government company. But I lost my job and my credit score went low due to defaulting on financing payments and I could not get financing from the bank. I have contacted the developer asking them for refund or change of payment plan but they give me instalment plan for 5 years and increased the price which I cannot go for. I am not in a stable situation with my current job and the company gave me 3 months unpaid leave because of Coronavirus situation. The developer completed 100% construction and they sent me a building completion certificate in Jan this year and now they are calculating 3% late payment fee every month as per SPA. Now I do not have any source of income. Can I get refund from developer so I can cover my expenses?

س: قبل أكثر من سنتين عُرِض علي شراء شقة بمجمع سكني لم يبنَ، ولأنني لا أملك مقدَّمًا، طلبت تمويلاً بنكيًا وانتظرت الموافقة. قال لي موظف الشركة: ادفع أي مبلغ الآن للحجز وهو قابل للاسترداد. دفعت المبلغ لكن لم أحصل على قرض البنك وعندما أخبرت الموظف أنني لا أستطيع الشراء وطالبت برد المبلغ تهَّرب. عندما راجعت الشركة قالوا لا يمكن استرداد المبلغ مع العلم أنه لا توجد أي معلومة واضحة من الشركة على أن الدفعة لا تُرد إلا بعد الدفع. كيف لي أن أعرف أنه لا يمكن الاسترداد قبل الدفع؟ الموظفون لا يعطون المعلومة الصحيحة. هل يحق لي رفع قضية بناءً على أنه لا توجد معلومة مسبقة من الشركة؟

Q: Hello, We have purchased an off-plan commercial property in Dubai which was due for handover in Dec 2017 but still incomplete. Delivery and handover should take place around mid-2021. The developer is asking to pay the VAT completely before year-end. I have read that VAT must be paid at completion but the developer insists on VAT payment by December. What should I do? س: مرحبًا، اشتريت وحدة عقارية في إمارة عجمان عبارة عن محل والمفروض الاستلام في سنة 2018 وتم التمديد حتى 2019. نسبة إنجاز المشروع حتى اليوم لا تتعدى 57%. كانت هناك مخاطبات بيني وبينهم ولم يتم التوصل لاتفاق. قمت بمراجعة دائرة التنظيم العقاري وتم الاجتماع مع المحامي والاتفاق على إرجاع وسحب المبلغ المدفوع من قبلي كاملاً من حساب الضمان بالتراضي بين الطرفين وقد وافق على ذلك محامي الشركة. الآن حين تابعت الموضوع مع المحامي، قال إنه سيحضر عقد الفسخ وسألته هل سيكون المبلغ المُستَرد كاملاً لأنه من حساب الضمان؟ قال سيتم خصم نسبة باعتبارها رسوم إدارية وهي نقطة الخلاف معهم؛ فهل يُسمَّى العقد فسخًا؟ وهل يحق لهم اقتطاع نسبة من المبلغ المسترد من حساب الضمان؟ علمًا بأنني أستحق أيضًا مبلغًا تعويضيًا يجوز أو يحق لي المطالبة به. يُرجى الإفادة وشكرًا!

س: سلام عليكم، قام المطور بتقديم رسالة فسخ عقد بسبب تأخُّري عن دفع دفعة أخيرة فقط بقيمة ٧٥ ألف من أصل ٣٧٥ ألف. سبب تخلفي عن دفعها هو تأخُّره عن إكمال المشروع بما يقارب ٣ سنوات. أثناء تقديمه للرسالة، أبرمنا اتفاقية ودية بأن أدفع المبلغ على دفعات بسبب عدم قدرتي حينها. دفعت ٢٠ ألف وبعدها ٢٥ ألف في غضون ٣ أشهر وهي المدة التي كانت فيها الرسالة قيد التنفيذ من الجهة المرسلة. بالرغم من إرسالي كافة المستندات للجهة المرسلة إثباتًا للدفع، إلا أنه تم إكمال الإجراء وفسخ العقد. مع العلم أنه عند مراجعتي للجهة المسؤولة وإثبات أنني قمت بسداد ٤٤.٣٪؜ من أصل ٥٠٪؜ قبل إيصالي رسالة فسخ العقد، لم يقم المطور بإعطاء بيانات كاملة عن دفعاتي وبالتالي اتخذت الجهة قرار فسخ العقد مع علمها بعد ذلك بأنني سددت ٤٤،٣٪؜ ولكنها طالبت المطور بإرجاع الوحدة ولكنه باعها لمشترٍ آخر فور حصول على نسخة فسخ العقد. إلى الآن المطور لا يجيب ولم تتخذ الجهة أي إجراء ضده وفي الأخير أهدرت أموالي. سؤالي: هل لي مقتضى مما ذكرت بشكل قانوني؟ وبأي طريقة أستطيع رفع دعوى قضائية ضده للتعويض؟ ما تكلفتها؟ وهل قضيتي مضمونة باسترجاع المبالغ؟ إن كانت نعم، فكم تستغرق؟

Q: Dear sir/madam, In January 2017, I purchased a property from a developer. The original booking was for a unit in (.......). After initial payments, I was informed that the unit was double-sold (under dispute) and the previous owner was not willing to sign a release NoC. A swap unit was offered in (.......) - due to be delivered in a few months. Due to construction issues, even 2 years later was not ready for delivery. After escalation, a unit in (.......) was offered as a second swap. All payments were completed on time for each of the units. Almost 3 years of following up passed now since making the final payments in April/May of 2019. I was not informed that the unit is under group mortgage and Title Deed can not be issued until the mortgage is cleared. Always promises that the unit is on priority for clearance. What is the possibility of getting a full refund of all amounts paid under "breach of contract" or any other applicable grounds? I would also like to know a cost estimate for any legal proceedings.

Q: Hi, We bought an off-plan property from a developer in March 2023. We signed the SPA, but the developer hasn't signed it yet; telling us it takes time. We have already paid 40%, but the construction has not started yet, according to the information in their application. Can we request to stop paying any future installments?

تحظى المعاملات العقارية باهتمام كبير بالغ الأهمية في دولة الإمارات العربية المتحدة وبخاصة في إمارة دبي لما لها من شهرة واسعة النطاق في هذا المجال. لذا خصص سمو الشيخ محمد بن راشد آل مكتوم حاكم دبي المرسوم رقم 56 لسنة 2009 الخاص بتشكيل لجنة قضائية خاصة للفصل في الشيكات المتعلقة بالمعاملات العقارية لإمارة دبي.

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
