Q: Hello,
I would like to ask about the applicable principles in case of termination of an employee's contract.
The employer added a clause of "Compromise Agreement" to the "End of the employment settlement agreement" where he declared warrants that employee can't issue proceedings or any claims "in connection with the employee's period of service and the employee undertakes that neither the employee nor anyone acting on the employee's behalf will present such application, or claim at any time after the termination of the employee's employment"
There are 2 other paragraphs where they specify to which all entities you are not allowed to issue these claims - including Ministry of Labour or other court withing UAE. the 2nd paragraph is covering international entities.
I know this practice from other countries where it is possible to declare almost anything. But these parts of the contract will never be taken into consideration based on the country law. The parties are using these only to threaten the other party.

Signing a clearance of labour entitlements for visa cancellation

Q: Dear Mr Khalifa
I have recently resigned from my company in Dubai where I have worked for over six years. Currently, I am serving the notice period up to 30th June 2019.
I resigned on 11th June 2019 but my company is asking me to serve 30 days notice period. The reason for leaving is they are not paying me my salary on time which has now increased to almost three months.
My dues include 3 months salary (April, May and June 2019), 6 years gratuity and 10.5 days annual leaves. The total amount due is around AED 115,000.
When I asked my company to cancel my resident visa (which is already expired on 22nd June 2019), they have sent me the final settlement which states the following declaration:
"I, the undersigned do hereby certify that I have received all my dues from my Company/Institution and I have no right to make any claim after this date."
I told my company that the dues are not cleared yet, how can I sign this form? but they are saying that this form will not affect my dues.
Please advise.

I have a labour case in Dubai Courts and got the final judgment on my favour. Now, I am going to open the execution file. If I withdraw my case, the company is ready to pay 50 per cent of the amount.
Will the execution court make any negotiations if the employer ask for deduction? Will it take a long time to make the execution?

Is it possible for the employer to drop a case filed by employee in free zone?

Q: I filed a complaint to SHAMS regarding unpaid salaries.
My employer drafted a contract saying I should drop the complaint within a week. If I fail to do so, they have the right to do it themselves.
Is this acceptable?

Q: Hi Sir,
What is the process for closing a labor case?
My case was transferred from MOHRE to the labor court. I have gone to ENJAZ (labor court) to close this.
So they made an application and said that after 7 days come here, but I don't want to proceed with it.
I want to close this.

Q: I want to settle my labor case with my employer out of court as they are willing to around pay by cheque 60% of the claim amount (I have an employment offer).
Can I do this (accept less than the claim amount) & how to withdraw the case?
My first hearing is next month.

I filed a case to cancel my visa and pay my dues but my company asked me to withdraw it. What to do?

Q: My company told me to find a new job last November, as they will stop operation from January 2024, though they renewed their Trade License. They said they have no intention of renewing my visa.
In December, I found a job and asked them to cancel my visa but they requested me to stay until 15th January. My Visa expired on 20th January. but till now they haven't canceled my visa, nor given me my December and January salaries and my gratuity.
So I filed a complaint in labor. Now the PRO calls and asks me to cancel the complaint so he can cancel. What should I do?

Can I withdraw my hit-and-run case to cancel my visa and leave the country?

Q: Dear Sir/Madam,
My car was hit in a hit-and-run incident in front of police personnel, and they asked me to file a case. So I did, and now it has been 5 months, but the case has not yet been resolved.
Now, I want to cancel my visa and leave the country. Can I withdraw my case due to this, and what could happen after?
The case has been at the prosecution stage for more than 3 months now.
If you could advise me on this, it would be greatly appreciated as I intend to start my studies abroad.

I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

I have multiple cheque execution cases filed against me due to financial strains last year.
My trade license and visa will expire next month, along with my Emirates ID.
Is it possible for me to renew my license and visa along with EID prior to settling the execution cases?
The trade license and visa were issued by the free zone authority.

How to file a case against my former company for unpaid salary I was not on their visa? 0
Dear Legal Advice Middle East,
I hope you are well.
I am seeking legal advice regarding an unpaid salary issue with my former employer, [-----]2 LLC. I was employed with them from December 4, 2024, to January 7, 2025, on a monthly salary of 5,000 AED.
However, I only received a partial payment of 2,473 AED on February 24, 2025. The remaining 2,527 AED is still unpaid.
I submitted a complaint to MOHRE on March 2, 2025, but I am unable to proceed further through their official channels.
This is because I was working under the visa of my previous employer, [---] LLC, and not under [----]’s sponsorship.
As a result, I do not meet the criteria to file a labor complaint via the MOHRE app or hotline.
Given this situation, I would appreciate your guidance on how I can legally pursue the recovery of my remaining salary, considering the complications related to my visa status during the employment.
