2
Q: We invested in a clinic venture (LLC) as a 25% partner with an investment totalling approx. AED 600k.
The starting date of the clinic was supposed to be 31 December 2018 as per the sale and purchase agreement. 9 months have passed, and even the basic inspection to activate the license has not been done.
I want to file a case against the original investors whose scope of work includes the activation of the clinic license, as they are currently deceiving me and creating excuses not to start the clinic.
They haven't shown till date a breakdown of expenses and where my investment has gone as the condition of the clinic has worsened.
Additionally, they are now asking for more money or threatening to close down the clinic as they haven't paid the rent for 5 months and have informed me only this week.
Kindly help me in this case. What can I do?

Return of a paid investment to a partner willing to quit
2
Q: Hi,
I invested in a hotel business in Dubai with 7 investors including me. the cost invested by all of us was 1.05 million.
One of the investors ran the restaurant full time every day, for 20 months. The guy who ran it full time cheated all of us by not paying us even a single penny in 20 months & made sure the debt goes up above AED 750K.
The other 6 investors don't have any legal proof as we only invested funds. The document owner is the guy who ran the restaurant 51% & the other 49% is on friend's wife name.
He hasn't paid salaries to staff, rent, vendors, vat nothing. We investors even invested additional 300k to pay rent initially, and even that he did not return us. He cheated us.
Now all investors have decided to kick him out & invest more funds to clear the negative 750K. I don't want to continue with these guys anymore, so I want to quit. But they are asking me to quit with zero!
I have invested AED 156500 & they are not ready to pay even one dirham. Please advise how to get at least some of my investment.
Please help.

How to recover post-dated cheques issued by the employer after resignation
1
Q: I have worked in a contracting company for 2 years as a supervisor. During the pandemic, the company faced problems with payment and projects.
That time, my visa also expired and I told them that I will not renew it because I need to get back to my home country.
Meanwhile, the company is facing some financial issues and they assured me they will clear my dues later and I agreed to get post-dated cheques.
I have 4 cash cheques dated 28.10.2020, 28.11.2020, 28.12.2020, and 28.01.2021 which all are cash cheques but unfortunately, still one single cheque didn't pass because of insufficient funds in an account.
I have been asking my boss politely for paying for the past 8 months. In the beginning, he behaved normally and asked me some more time but now he is telling me that because of me, some projects got problems and he didn't get payments.
Now I am in India and I have some medical issues for which treatment is going on. Presently I can't come to the UAE to fight with him. Is there any way to get my money back?
Please help me to get my money back.
Thank you!

How can I get money invested in a company after I got cheated by my partner?

1
Q: Hello.
I invested almost 60,000 dhs in a company to be a business partner in the future and get power of attorney.
But my business partner lied to me, he took all the money and now our business is almost closed.
I asked him to pay me all the money I gave to him (with papers he signed in) and he is not paying me. It has been like this for almost 2 years now!
Do I have any chance of getting my invested money back?
Thanks

Can I claim all the cheques, even though some will cover the amount owed?

1
Q: Dear Sir/Madam,
I have invested money in a company in the UAE and got post-dated cheques. They requested to delay the payment for a long time. Now, I deposited one cheque and it bounced.
I am creating a cheque execution case. However, I have a few more cheques to deposit that they owe me. They gave me around 5 cheques, of which 3 will cover the money they owe.
Can I claim all the cheques? Will I face legal issues from them?

View allCan you enter Dubai if you leave a GCC country with possible civil and criminal cases? 0
Hi Hayyan,
In 2014 I had been to Qatar on a "Work-Business" visa valid for 30 days. Before my visa expiration, I fled from Qatar back to India without informing the sponsor or office management.
After I returned to India, I received an email from HR stating that the Qatari sponsor has filed an absconding case, a civil case, and a criminal case against me with the Ministry of Interior in Qatar.
Now my question is, can I travel to Dubai on a work visa?
Will there be any issue entering Dubai assuming that the Qatari sponsor has filed the said cases against me?
Awaiting your response,
H.

Help with drafting service provider agreement for marketplace tech startup 0
We are a tech startup creating the first auto/car service and repair marketplace.
As a marketplace, we only facilitate listing and booking the services while the service providers (the workshops) are the service providers and are responsible to deliver and carry the selected /booked job.
We need to draft a marketplace supplier/service provider agreement between us and the workshops outlining the responsibilities and liabilities of both sides.
I would like to work with a law firm that has previous experience in drafting such marketplace-related agreements.

View allHow can I renew my Ejari if the landlord hasn’t signed the new contract? 0
Hi,
I have been here for 3 years now and paid the increased amount (as per the agreement) for the 4th year.
However, the landlord did not send me back the signed contract, although I have both made the payment for the full year via bank transfer and sent my signed contract to him.
I need to renew my Ejari; however, how can I do it without the landlord's signature?
I have all the previous contracts signed by both parties, along with the Ejari for those contracts.

My company has filed a case against a client for failure to pay and bounced cheque. How to follow up? 0
Hello.
My company has filed a case against a client for failure to pay and a bounced cheque. The client's company is registered as a virtual office in the Creative City Free Zone in Fujairah, so our case is filed there.
The client basically purchased some equipment from us, and his payment via bank transfer did not go through and was rejected. Then, when we deposited his security cheque after multiple attempts to contact and no answer, the cheque bounced.
The company is under his wife's name, and we have filed a case on the same.
The court has accepted our application, however, they have instructed the execution bureau to get the Emirates ID of this authorised signatory. The bureau is asking us to get it, and we have no way to do so, unfortunately.
Without the Emirates ID, the court cannot freeze the bank accounts or put a travel ban, etc.
What are our options here?

Additionally, please advise on how to proceed with custody, as my son currently resides with me.

How to transfer the shares of a company from his heirs to the partners? 0
A company is registered in a free zone (Dubai South) and had 4 shareholders.
But now one of them passed away and the successor is a very old lady, who is not cooperative and will not be able to sign any document at all (and she lives in another country).
We have no idea who will be a successor after this old lady and these people will in fact never be interested to do anything with this company.
The company is financed and managed by only one shareholder, who is willing to continue.
What can be done in this scenario to keep this company and continue operations?
How to transfer the shares of the deceased shareholder (buyout, shares transfer)?
Is there any court procedure where if no one claims their rights after some time, the shares will automatically be transferred to the company itself or the third parties?
Thank you.
A.

I have already cleared the amount specified in the legal notice, but my landlord is now saying that I also need to clear further late fees as per our contract within the legal notice time period.
Is that valid if it is not stated in the notice?
