Q: I went to a hospital to have a medical check-up as I had a weird feeling, they ran the tests and they told me that I am fine and nothing is wrong and that I am cancer free. A year later, I went to the same hospital as I have been informed by another hospital that I may have breast cancer, they ran the tests again and they said it is a benign tumor.
However, when I traveled back to the US and had another check-up I was informed that the tumor is malignant. I had to go through surgery and chemotherapy and be absent from work for a long time to get the treatment. I was also informed that if I had known about it the first time I was diagnosed, there would have been a better chance to cure it at early stages.
Can I claim for compensation from the hospital for negligence and how much can I claim for?

Q: I was diagnosed with a liver disease and the doctor took a liver biopsy and when I came to see the result of the lab I was informed that they did not send the sample to the lab on time as the lab was closed for one day and then they forgot to send it again and after a week they present it to the lab and they informed them it was too late as the sample is damaged since it is supposed to be sent within 48 hours. Now I have to make another biopsy - which is for your information is not an easy procedure - for a mistake made by the hospital.
Can I claim for compensation?

Q: I'm residing in Kingdom of Saudi Arabia and a citizen of India. I ordered a new Samsung Galaxy Edge Plus mobile on 05-04-2017 from www.dubaiphonestoes.com which is located in Office No-03, Ayal Nasir 116-447 Deira, Dubai, UAE. I received the product through DHL and Fetchr on 09-04-2017 and I paid SR1250.
On 14-04-2017 when I unpacked the phone I was shocked because the phone was not the normal one what I ordered and it was a customized model mobile for AT&T. I can’t use my Saudi SIM-cards in the mobile.
Also, the box for phone says the mobile color is Safire black and the product inside is gold. How it comes?
They also specify the country of origin is Dubai and the product is from the USA. And when I made the order in the special request I mentioned I need a 64 GB Phone and they sent me a 32 GB phone.
The website www.dubaiphonestores.com is registered in an Indian address and they are operating from Dubai.
How can I legally fight with them with UAE laws?

Consumer protection and the concept of "cooling period"

Q: Is there a law regarding a "cooling period" on an item purchased?
We had a problem with a company distributing vacuum cleaners in Sharjah, we have returned the item to them as we felt like being pressured to buy without giving us time to think before buying, and their contract states that I have to pay 4,000 Dirhams as a cancellation if I return the item within 3 days.
Is it legal? Where is the 3 day cooling period?

Claiming compensation for dental malpractice

Q: Hi.
I won a DHA ruling of malpractice against a Dubai-based dental clinic and need to go to court to recover the money I paid out.
I’m also hoping for some compensation for the year of pain and inconvenience I went through as a result. I'm told that I have to pay 6% of my claim up front. How much should I claim?
I spent AED 30,000 on the original dentist and AED 80,000 correcting the problem. I gave a statement as part of the malpractice case.
As I have already won this, do I still need a lawyer to represent me, or would the judge use my original statements?
I appreciate any advice on this matter.

Q: Hello,
Please, I need to check travel ban on my passport, but I saw that you asked for a valid passport and my passport will be expired on September 2018 is it ok?
Also, I need to speak about my problem, and please, I need an advice.
I was supposed to be hired by a medical centre recently, but after they took all my confidential documents and invited me to training sessions too, suddenly without a reason they told we withdraw the offer!!
So I criticized their hiring issue on google and they made a case against me for that, although I just explained the incident and didn't mention names or bad words or anything.
Now, I don't know what to do and totally lost as I didn't know if I wrote my experience which was very unfair and harming for me so I can be sued for it...
Please help!

Blogging about a restaurant and giving a negative review

Q: We are food bloggers and were invited by a restaurant to review their food. Once we arrived, the owner said she did not know of this.
When we showed her the written confirmation from her husband she refused to accept it.
They wasted our time and money, making us come all the way to her restaurant just to be told to get out.
She was becoming hostile so my sister took out her phone to take a video of her screaming at us.
But when the lady noticed the phone she attacked my sister. She pulled and scratched her very badly. She left a big mark on my sister’s arm.
When the police came we were told to delete the video which we did in front of them itself.
Once the police left, she threatened us that if we ever mention this to someone, post about it on Instagram, or leave a bad review on Zomato, that they will take us to court.
Can she do this? I only want to write an honest review on Zomato where I explain our situation and post the pictures of my sisters arm.
Or can she make a case on us?

Q: Dear Sir/Madam,
I asked a veterinary clinic to tell me what the names of the last medications I paid for were. The vet had handed them to me in a rush and never billed me, and I had come in on my own to pay.
The receipt for which I thought the payment was turned out to be for something completely different. The vet has no notes on the matter. Same with the manager who took the payment.
I have asked them to check the CCTV as I remember the date and time, but no answer. I don’t know if this is illegal!
If I mention this incident in a review, could there be legal repercussions for me?

How to guarantee my right in accrued leave days or payment 0
Dear Sir,
My contract is a fulltime employee for a company in the UAE, and my leave entitlement state 10 weeks work and 2 weeks off.
However, due to the COVID-19, I have been unable to take that leave and have accrued two months leave or 61 days with four flight tickets.
My question is, can my company legally cancel those accrued days at the start of the new year or would they have to pay me for those days?

Good morning All,
I was terminated by my company in March 2020 for not signing the unpaid leave document given to me. I was terminated on 23rd March 2020.
Once termination letter was signed, ever since then, I have been chasing my ex-company for releasing the final settlement and each time they come up with a different plan.
The last option they gave was to sign an agreement with them for 6 months plan but are not giving me any guarantee cheques and insist that I sign the cancellation papers. I want to simply take my money and leave the UAE.
They have also directed me to their lawyers now who insist that any agreement signed with the company is not required to be notarized by Dubai Courts and the company is not legally bound to give me any cheques as a guarantee.
The company that I worked for is located in Dubai and is a private organisation.

Following up on a labor case after traveling to the home country 0
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?
