Q: I bought a real estate unit more than 3 years ago. The project has been cancelled and at the cancelled real estate project committee in Dubai Courts for more than a year. I don't know how to follow up with them as they are not responding to my calls or emails.

Q: How do I have my deposit returned from a canceled project? The deposit was paid in October 2008.

Q: I have a 2 BED room apartment and the project is on hold for a very long time. According to the Dubai land department, the project is going to be canceled and my money is stuck in this. How can I get the money back?

Q: We purchased 2 flats in Feb 2008 from a developer in Jumeirah village circle in Jouri 1. We paid AED 456,000 and AED 467,000 till Dec 2009 but no construction was done. Recently, we checked the DLD website and found that Cadi 5 was on the list of canceled projects and our names were missing in the 2 units. So we require help in 2 issues. First, to have our names included as owners of the flats. We have all agreements, account statements, and receipts. Second, to help us recover the money. We are in India and visiting Dubai from 26 Oct to 2 Nov 2019.

Q: I'm a landlord and had taken services from a company for repairing the AC in my townhouse. The guy working for the company asked me to transfer the money to an alternate account to expedite things. He was not able to fix the problem and was also very rude to our tenant. In the end, he returned the parts and we ended up fixing it from another vendor. Now they are not returning my advance of AED 1300. How do I sort this out? Q: Dear Lawyers, I have a question regarding a new developer taking over a property from an old developer who fled Dubai many years ago. The new developer is trying to get investors to sign a new SPA, which includes additional fees. I have not signed the new SPA yet. The new developer claims: "The Judicial Committee for Incomplete & Cancelled Real Estate Projects in the Emirate of Dubai approved the continuation of the project as planned and instructed the new developer to issue amended SPA contracts to all investors, taking into consideration that non-compliant investor contracts shall be canceled in accordance with the procedures and regulations applied." Accordingly, as per the verdicts, they request all investors to comply with the decisions and verdicts issued within a 15-day notice. I have paid 80% of the total fees, and the project is about 60% complete. Does the new developer have the right to cancel the old SPA and take my unit if I don't sign the new SPA? Also, can I request the project to be completed?

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.
