Compensation for an accident caused by a school car driver
Hi,
I was crossing the road when a driver of a school car rolled over my ankle. It was dislocated.
I was hospitalized for 4 weeks. They discharged me as an outpatient. Till now, I am still having appointments for checkups.
My question is how to claim compensation?

You have the right to claim damages for the accident that can be physical, mental, financial, etc.
A criminal report was recorded at the time of the accident so, after the judgment of the criminal case, you can file a civil case in the civil court for your compensation against the defaulter or his insurance.
You need to submit criminal court judgment as a supporting document. You should also submit your medical report, expenses bills, other supporting documents of losses and income.
You will be compensated by the insurance company of the defaulter in absence of the defaulter, the driver, who needs to pay the damages.
You can make a settlement with the insurance company in this situation. The insurance company always offers a very low amount, therefore, it is always recommended to file a case in the civil court by appointing a lawyer and getting a reasonable amount of compensation.

You have the right to claim compensation according to Article 282 of Federal Law No. (5) of 1985 promulgating the Civil Transactions Law of the United Arab Emirates, as amended by Federal Law No. (1) of 1987 AD which states:

The police prepare an accident report and document of the site. After the judgment of the criminal case, you can file a civil case in the civil court and claim compensation against the defaulter and his insurance.
The documents required for filing a compensation case are stated below:
• The police report, (that includes a full investigation report with the accident scene).
