Maternity leave and related rights under the UAE labour law
13
Q: Hello.
I need to know my right. I was on my maternity leave and I took an additional 1-month leave along with my maternity before leaving so I can be with my little one for more time.
However, I got pain and infection in my stitches as it was my second c-section. I took a doctor leave and sent it to my company for an additional 2 weeks' leave extension, but they refused.
So I told them it's not possible for me to work at the moment hence consider it my resignation. Now, they are not paying my gratuity and end of service benefits and trying to deduct one-month salary as I didn't serve my notice.
I'm concerned because I never had intentions to resign and requested for leave. They left me no choice even I sent a proof to them the doctor's documents as support.
They shouldn't deduct one-month salary as notice because it's not my fault. Can anybody help?
Moreover, the time they don't pay or deduct I want to go legal way to challenge them.
Is it possible??
Help me, please.

Claiming maternity leave compensation upon resignation

Q: Good afternoon,
My concern is about maternity leave.
I quit my job last week, my last day of work will be 20 April and I discovered that I am pregnant. My first day of work was on 16 May 2018.
As I am pregnant, should they give me any extra compensation when I leave? (for the 45 days that are my right to take for maternity leave).

Maternity leave followed by unpaid leave, can we consider sick leave on a prorated basis?

2
Q: Dear Sir/Madam,
After completing three years, an employee will go on maternity leave starting from March 4, 2024.
Following approved maternity leave, the employee will take unpaid leave. The employee has already used all available annual leave and utilized 25 days of sick leave at the beginning of the year.
If the employee goes on maternity leave followed by unpaid leave, can we consider sick leave on a prorated basis?

My previous organization has not yet released EOSB because I contacted a client. Is this legal? 0
I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

The trade license and visa were issued by the free zone authority.
I look forward to your response.
Thanks.

How to file a case against my former company for unpaid salary I was not on their visa? 0
Dear Legal Advice Middle East,
I hope you are well.
I am seeking legal advice regarding an unpaid salary issue with my former employer, [-----]2 LLC. I was employed with them from December 4, 2024, to January 7, 2025, on a monthly salary of 5,000 AED.
However, I only received a partial payment of 2,473 AED on February 24, 2025. The remaining 2,527 AED is still unpaid.
I submitted a complaint to MOHRE on March 2, 2025, but I am unable to proceed further through their official channels.
This is because I was working under the visa of my previous employer, [---] LLC, and not under [----]’s sponsorship.
As a result, I do not meet the criteria to file a labor complaint via the MOHRE app or hotline.
Given this situation, I would appreciate your guidance on how I can legally pursue the recovery of my remaining salary, considering the complications related to my visa status during the employment.

What can my wife do if the company marked her as single and denied her maternity coverage? 0
Hello,
My wife's company renewed their insurance and registered my wife as single, so the maternity benefits are not covered, even though we were already married before she joined the company.
She is now 35 weeks pregnant. What should we do?
