Q: Hello
A DIFC based company I work for hasn't paid 5 months worth of salary, plus business travel expenses. The total so far is around AED 700K. In addition, if I leave the company, there will be the gratuity and pay-in-lieu of unused vacation.
The company is offering me post-dated cheques (cheques are in the name of the company, the signer is the group president and one of the shareholders). I am trying to get cheques above AED 200K (because if the cheques bounce it is a criminal charge, right?)
1- What are the consequences for the company and the owner if the cheques bounce? Will the signer face prison and travel ban?
2- How do I raise a complaint about the bounced cheques? Which police department or government authority I need to go to?
3- If the signer says the company doesn't have money to cover the cheque, because the company is not generating revenue or has many assets, then what happens? does he get away with it? Or goes to prison and faces a travel ban?

Q: Hi
I have logged a complaint against my employer yesterday because he refuses to pay my end of service benefits + 2.5 months' salary, neither is he willing to give me any post-dated cheques.
After 48 hours, the legal team from the labour office will call us. I served my notice period with my last day being 6th Oct 2018.
My question is, I have a new job and my joining date was supposed to be 7th Oct, now without cancellation, how do I go about my new job?
My passport and ID are with my present employer.

Claiming labor entitlements after signing the cancellation paper

Q: I work for a company in IMPZ Dubai. I resigned on June 23 & my last working day was on July 22, 2018. My employer has not paid 2 months' salary & gratuity till date.
The company forcefully asked me to sign the cancellation paper and my visa got cancelled on August 16.
I have an email from the vice president of the company dated August 24 confirming that my settlements will be paid soon, and they mentioned in my settlement calculation that my dues will be paid upon visa cancellation, as this is their company policy.
Few other employees have left the company recently & the management followed the same process. i.e. visa cancellation first and then settlement of dues.
Kindly advise, how can I get my rights?

How to recover post-dated cheques issued by the employer after resignation

Q: I have worked in a contracting company for 2 years as a supervisor. During the pandemic, the company faced problems with payment and projects.
That time, my visa also expired and I told them that I will not renew it because I need to get back to my home country.
Meanwhile, the company is facing some financial issues and they assured me they will clear my dues later and I agreed to get post-dated cheques.
I have 4 cash cheques dated 28.10.2020, 28.11.2020, 28.12.2020, and 28.01.2021 which all are cash cheques but unfortunately, still one single cheque didn't pass because of insufficient funds in an account.
I have been asking my boss politely for paying for the past 8 months. In the beginning, he behaved normally and asked me some more time but now he is telling me that because of me, some projects got problems and he didn't get payments.
Now I am in India and I have some medical issues for which treatment is going on. Presently I can't come to the UAE to fight with him. Is there any way to get my money back?
Please help me to get my money back.

I terminated the services of an employee. How can I cancel his visa if he refuses to sign the clearance of dues?

Q: I am an employer and I terminated the services of one of my employees before the end of the probation period. He refused to sign the clearance letter of all dues and asked for 2 months' notice pay and other benefits which he is not entitled to in the probation period.
What can I do now to cancel his visa?
The company is in DIFC, Dubai.

What is the jail term for a criminal case of a cheque totalling amount of 1,330,000/-, 9 cheques of AED 40,000/-, 12 cheques of AED 50,000/-, 1 cheque of AED 120,000/- (all on the personal name), & 1 cheque of AED 250,000/- (on the company's name) in Sharjah?
Could we file a civil suit for the same as the person doesn't get released until he pays & clears the cheque amounts?

How to guarantee my right in accrued leave days or payment 0
Dear Sir,
My contract is a fulltime employee for a company in the UAE, and my leave entitlement state 10 weeks work and 2 weeks off.
However, due to the COVID-19, I have been unable to take that leave and have accrued two months leave or 61 days with four flight tickets.
My question is, can my company legally cancel those accrued days at the start of the new year or would they have to pay me for those days?

Following up on a labor case after traveling to the home country 0
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?

When does the salary change after an internal position change? 0
I am a fresh graduate who has been a full-time intern with a company that only covers transportation for over a year while completing my studies. I graduated this May.
In March of this year, they offered me a full-time employment contract since I was now near completion of my degree.
They still kept me on the internship allowance (AED 1000) until I submit all documents for visa processing.
I have submitted all my documents for processing towards the end of May. My grace period after cancellation has also expired on the 25th of June.
They are still paying me the internship allowance. Now that the visa is pending on their side, shouldn't they be paying me the full salary?
I also think they should have paid me the full salary once I signed the contract regardless of the visa status since I was already working for them.
Please let me know whether I should push the company to pay my full salary since the time I signed the contract (March) or only since this month (visa pending on their side)?
