حصلت على قرض شخصي وكريدت كارد من مؤسسة للتمويل بإجمالي ٥٠ ألف وتعثرت لفترة والآن يطالبونني بدفع مبلغ ٢٠٠ ألف درهم بالفوائد وكنت أعطيتهم شيك بقيمة ٤٢ ألف وقتها. سؤالي: هل يوجد سند لأمر داخل عقد القرض (الأبليكيشن) الخاص بالشركة التي وقعت معها في البداية؟ أم لا يملكون ضمانًا آخر يُمكِّنهم من مقاضاتي به سوى الشيك الذي أعطيته لهم فقط؟ مع جزيل الشكر!

هناك مشكلة مع مقاول إذ اتفقنا على بناء ملحق داخل منزل خاص ووقعنا العقد واستلم أول دفعة. اشتغل حسب العقد واستلم الدفعة الثانية وأوقف العمل ويرفض المواصلة. تبين لي بعدما حاولت أن أقدم شكوى ضده أنه يستخدم ختم وعقد لشركة منتهية في سنة 2013 ولا يوجد لديه أي ترخيص. كيف أستطيع أن أشكوه وبنفس الوقت أواصل البناء؟

My wife and I are non-Muslims. Divorce was settled in our home country court which decided that I am the custodian of the children and no alimony has to be paid to her. Children are living with me here in the UAE. However, she still resides here in the UAE using a tourist visa. She is planning to file a Maintenance Case against me in the UAE Family Court. Can she do that? Am I obliged to pay her alimony?

Hello I bought an off-plan apartment with a developer, paid half and the other half was supposed to be paid on receiving the apartment which was supposed to be received end of 2019. I am located in Dubai. Since it requires a free subscription, I want to ask if I am obliged to register it as business anywhere to be legal, or if I do not register, I will be asked or arrested for running this website. The website is under maintenance at the moment, it will be broadcasting after it is completed. Some points I am really concerned with: 1- Do I need a legal registration of the website as a business? If yes, can you help me find out how? If I register in one country - let's say UAE - will it be legal in other countries e.g UK, US? 2- GDPR is really critical point that we have to consider especially for websites that collect info from visitors if required. I am a manager in a UAE company, I have served 2 years on an unlimited contract. I have been instructed I am on unpaid leave for a 3-month period in light of the current situation. The company is asking me to sign an annexe to my contract that I accept this unpaid leave period. If I do accept, can I still resign during this 3-month unpaid leave period if I get another job?

I should have my final settlement on May 9 as my last day of work will be May 2nd. The company offered me to pay me in 2 payments. A bank transfer was made in the 1st week of May and the second 50% in the 1st week of June by giving me a post-dated cheque. The issue is I didn't plan to stay 1 more month as I should leave the country. 1- Is this legal to offer this kind of payment? What can I do? 2- If I have to stay, they have to pay my expenses (rent and bills) to stay one more month in the country?

Hi, When a case gets transferred from MoHRE to Dubai Courts for non-payment of FNF by an employer (accumulation of salaries), what happens there at the court in terms of process, proceedings, charges, cost of hiring a lawyer...etc? In my case, I worked with a company and left them in April 2019; I have not received my dues till date. Have followed up multiple times; got a case raised as well but they still didn’t clear the amount. It’s been a year almost and I'm very stressed out because of this. Please advise, what can I do? We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day. We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds." We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it. We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.

Hello, I want to inquire regarding my leave privileges. I am now 11 months in my company. How many leaves am I privileged to? Based on Decree-Law No. 33 of 2021 regulating labour relations and its executive regulations, you are entitled to a paid weekly rest for not less than one day, as specified in the work contract or the work regulation. The Council of Ministers may increase the weekly rest day stipulated in this article. The Decree-Law and its executive regulations also stipulate that you are entitled to an annual leave with full pay as follows: - Thirty days for each year of your extended service. - Two days per month in respect of any employee with more than six months and less than one year of service. - Leave for parts of the last year of your service in case it is terminated before you use your annual leave balance. Now my question is: do I have 22 days I can use? Can someone explain to me in detail? Thank you!

I got an order of 6 months imprisonment and deportation for a judgment in absentia by the Sharjah court for selling medicine without a license. I was not involved in the case directly; my friend used my car, and he had my bank card. They made a confession that they were working for me and made a false claim that they had transferred money to me. As I am outside the country, I came to the UAE to solve my case. I got detained at the airport, and the CID asked me some questions. I mentioned they didn’t transfer me a single Dihram, so he let me go, as the case was already open for appeal. In the first instance court, they gave me the same verdict, then I appealed and attached documents like bank statements and my company details, which were not mentioned before. They gave a date for the judgment, but it was not issued, and they gave the next date. I have been suffering a lot for the last 3 months here in the UAE and for 6 months back home. So my question is that what will happen next? Will the case be open for retrial, and will the CID be convinced by my logic? Can they drop charges, or now the court decide only?

رفعت زوجتي قضية طلاق للضرر ضدي وقت سفري للخارج وذلك بالضغط من أهلها، وقالت في لائحة الدعوى أنني هجرتها ولم أنفق عليها ولا على طفلي الاثنين وأنها استأجرت سكنًا خاصًا بعد أن تخليت عنهم، وهو لم يحدث جملة وتفصيلاً، وهناك ما يُثبت. تركت لهم المصروف الخاص بالبيت وهناك رسائل واتساب تشهد بذلك قبل السفر. ولكن لظروف مرض كورونا المنتشر حاليًا، لا يمكنني العودة بسبب إغلاق المطارات؛ ومع ذلك لا توجد مشكلة في إيجار السكن ولا المدارس وهناك مصروف لهم يكفي لمدة سنة. هل إن رجعت وقدمت ما لدي من مستندات تفيد بأنني أخبرتها بسفري لرؤية الوالد، ولدي عقد إيجار للسكن صالح لآخر سنة ٢٠٢٠، وحتى رسوم المدارس تُخصَم من حسابي في البنك مباشرة، يرفض القاضي طلب الطلاق للضرر؟ لقد أعدت حجز الأبناء في المدارس عن طريق الإنترنت للسنة القادمة ٢٠٢٠/٢٠٢١، هل هذا يكفي لرفض طلبها؟ مع العلم أن الزوجة لم ترفق أي ورقة في الدعوى تُثبت إدعائها بأنها قامت باستئجار سكن. أنا أملك تلك المستندات باسمي وجميع الرسوم المدرسية والسكن وقد أبلغتها عن طريق الواتساب بغرض السفر. مع العلم بأني مقيم في إمارة دبي.

السلام عليكم ورحمة الله وبركاته والدي مصري كان يعمل بوزارة التربية والتعليم الاماراتية منذ فترة 25 عام تقريباً وكان له رصيد في بنك وكان ينوي السفر لسحب الرصيد ولكن لم يشاء الله رب العالمين وتوفى والدي 8/4/2020. حالياً هل أستطيع أن أعرف هذا الرصيد بأي بنك موجود؟ أيضاً، هل يمكن أن أسحب الرصيد؟ مع العلم أن الوالد توفى دون إبلاغنا باسم البنك أو حجم الرصيد.
