Delaying salaries till the end of the current COVID-19 situation

I talked to my boss last night about my salary because it is more than 10 days late. He said that he will pay the salary after lockdown.

He also told me that if I want, he will go to his home to get the money and after that he will terminate my contract. It is possible?

I have 2 years limited contract and I am now 10 months in the company.

Please help!

Dear client,

Thanks for your query,

The limited contract can not be terminated before completion. The employer has to compensate by paying 3 months salary.

Thanks!

Can we file complaints against our employer for not paying or delay paying salaries? and I am sure 100% he will not give the full amount of salary for us. 50 - 75% only, he said, because of the corona crisis.

Yes, you can call on 80060.

Hi sir,

I have already filed a complaint regarding this matter to my employer, now he called me and asked me to cancel the complaint, after that, he will give me the salary. I am scared.

please help!

No, ask him to send confirmation from a company email. Otherwise, send you a letter confirming the due amount.

He will not give me the salary if I do not cancel the complaint. Is there any chance that he can file a complaint against me also?

I don't do anything; just ask for my salary.

19 Apr 2020, 11:53

Do not cancel your complaint as he can file an absconding case against you. Take it to court. Also, he has to pay you house allowance due to the Coronavirus situation.

Is it possible that he can file absconding case against me?

If you don't have labour complaint and did not attend to work for 7 days, then he can file an absconding case.

In all cases, your labor rights are reserved, whether you wait until after the close, or one of the parties decides to terminate the contract.

Dear questioner,

It is not possible for him to terminate due to the current situation; it will be considered as arbitrary dismissal.

Do not do that and register a complaint through MOHRE, after that they will call you and you will explain in detail what happened with you.

Please feel free to contact me via phone or email.

Thanks!
