Resignation without notice for the non-payment of salaries

Dear Sir,

I am working at a construction company in Dubai with an unlimited contract, the company not paying me the last four months.

I have another offer from an Abu Dhabi based company.

Can I resign from the current company without notice period? Is that legal? What should I do in this case?

Please advise.

Yes,

You can resign without notice period from the company because your employer failed to fulfil his duty towards the employee in accordance with the contract and the law.

It is legal, and when you resign, just mention the proper cause in the resignation letter why you are resigning if possible just make a complaint to Ministry of labour if the company is not cancelling your visa.

Hello.

Pursuant to Article (121) of the Labour Law, the worker may leave work without notice should the employer breach his obligations towards the worker, as set forth in the contract or the law.

The worker is eligible for unpaid salaries and EOSB.
