Q: I have four credit cards which I am using last 5- 6 years.
My financial situation has currently changed dramatically, and I am not in a position to repay the minimum payments.
Until the last month, all the payments were accurate. All four credit cards entitle to use AED 100,000.
As per my knowledge, the bank will file a case against me and I would like to know what actions can I take to avoid prison.
In addition, I think I need a lawyer so that he can take care of my documents and release me if they will catch me. Could you please tell me what will the next step be?
How can I get a court decision in my favor and obtain a police clearance certificate after all this?

Liability for the unpaid loan

Q: I was jailed for 4 months for not being able to pay a loan from a Dubai bank since I've lost my job in 2011.
After my release, I tried looking for a job but was unsuccessful, so I went back to my home country when my visa expired but still the bank is sending emails and threatening me and wants to collect money from me.
Now that I am back here in Dubai, they threatened to file a ban against me and told me that I cannot get my visa renewed if I will not pay them.
Can the bank do such THING? I already have accepted the punishment of serving jail time since during that time I didn't have a JOB and was totally broke. What can I do so that they will stop harassing me?
What does the law say if someone had served the sentence for a bouncing check case?

Responding to a police call if you have unpaid debts

Q: Today I've got a call from Dubai Airport Terminal 1 police station.
I've been asked to come to the police station without giving me a reason.
I have an unpaid bank loan but I am not aware of any court case in this regard.
What are my rights in this situation? Should this kind of request from police be in writing?
Can I ignore this telephone call and what are the consequences?

The issue with credit shield insurance

Q: HI,
I was recently terminated from my work on May 1, 2017. I have a credit card with outstanding dues with FGB. On May 10th, I had applied for the credit shield with the bank.
On application, they informed me that it would take 40-60 days to get credit shield approved. But it has been 4 months and it's still not approved.
The bank is repeatedly calling me for the minimum payment, which I am not able to do since I haven't received any new job offer. I visited the bank collection department and the credit shield insurance company with no proper reply from any.
The bank has now issued a legal notice and I do not have any proper reply from anyone with regard to the credit shield. I have been giving interviews and it's only a matter of a couple of weeks before which I might be employed again.
My question is, can the bank register case against me when the credit shield application is pending?
Also, will the case affect my legal status when new employer applies for new employment visa?

Consequences of a bounced security cheque after failing to pay loan installments

Q: Good day,
Look forward to your kind legal advice for my query below.
I am a resident of Dubai (Indian national) and I have an outstanding loan of AED 120000 with ADCB bank and they had bounced my security cheque on 15.11.2017 with amount mentioning AED 1400000 as I have defaulted last 3 EMI's (including November).
I tried my best by consulting bank's collection executives saying I can pay 1 EMI right now and remaining in next few days but no use.
What will be the lead time for them filing a case against me?
Can I walk out of police station by paying fine? If yes, how much?
If sentenced, then how many days/months will I be in jail?
My residence visa expired on 17.11.2017 and company said they will renew in next few days. Will it affect me coming out by surrendering passport?
Can I change job & visa if I have a case against me open?
Looking forward to your kind advice and suggestions so I can plan accordingly.

حصلت على قرض كريدت كارد من بنك في دبي، وبسبب الظروف الراهنة تواصلت مع البنك عند طريق الإيميل لتأجيل الدفعات ولكن البنك رفض وهددوني بأنهم سوف يرفعون قضية لدى الشرطة إذا لم أسدد الأقساط.
ما الإجراءات؟ هل تُدفَع غرامة وأُعفَى من المبلغ؟ وهل أستطيع السفر إلى بلدي بعد دفع الغرامة وما العقوبة والنتيجة؟

A bank increases the amount of installments of a loan without notification

Q: Dear Sir/Madam,
Greetings!
I am an ex-pat who took a personal loan from a bank in Abudhabi. I have 13 months of installments left. My bank changed my monthly installment amount last month without any notification. They charged me an additional amount of 1190 per month for the next 13 months.
When I contacted the bank, they said these are your accrued interest amount as I took deferment during Covid period. When I asked them how much the interest would be before taking deferment, they didn’t give me a proper response.
I initiated a query with customer care asking them to provide complete details about my accrued interest. They are ready to discuss only via phone & they can’t send any emails.
Can the bank charge a high-interest amount for deferment?
Kindly advise me on what I can do, please!

What is the jail term for a criminal case of a cheque totalling amount of 1,330,000/-, 9 cheques of AED 40,000/-, 12 cheques of AED 50,000/-, 1 cheque of AED 120,000/- (all on the personal name), & 1 cheque of AED 250,000/- (on the company's name) in Sharjah?
Could we file a civil suit for the same as the person doesn't get released until he pays & clears the cheque amounts?

How to guarantee my right in accrued leave days or payment 0
Dear Sir,
My contract is a fulltime employee for a company in the UAE, and my leave entitlement state 10 weeks work and 2 weeks off.
However, due to the COVID-19, I have been unable to take that leave and have accrued two months leave or 61 days with four flight tickets.
My question is, can my company legally cancel those accrued days at the start of the new year or would they have to pay me for those days?

How to guarantee labour rights before signing the cancellation paper 0
Good morning All,
I was terminated by my company in March 2020 for not signing the unpaid leave document given to me. I was terminated on 23rd March 2020.
Once termination letter was signed, ever since then, I have been chasing my ex-company for releasing the final settlement and each time they come up with a different plan.
The last option they gave was to sign an agreement with them for 6 months plan but are not giving me any guarantee cheques and insist that I sign the cancellation papers. I want to simply take my money and leave the UAE.
They have also directed me to their lawyers now who insist that any agreement signed with the company is not required to be notarized by Dubai Courts and the company is not legally bound to give me any cheques as a guarantee.
The company that I worked for is located in Dubai and is a private organisation.

Following up on a labor case after traveling to the home country 0
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?
