س: أنا زوج مُطلِّق وأريد تخفيض النفقة وذلك بعد تصفية الشركة التي كنت أعمل بها والحين لا دخل شهري لي ومعي ما يُثبت ذلك من الشركة نفسها. أريد معرفة الإجراءات المطلوبة لتقديم هذه الورقة للمحكمة لتخفيض النفقة.

س: كم قيمة النفقة التقريبية بعد الطلاق للأم والطفل الصغير إذا كان راتب الزوج ١٥٠٠٠ درهم؟ ما النفقات الأخرى التي سيدفعها؟ وهل يحدد هو مكان السكن أم يدفع فقط بدل سكن؟

س: السلام عليكم، طلقت زوجتي (لا يوجد أطفال) طلاقًا رجعيا أوليًا بإرادتي المنفردة. نحن من سكان إمارة أبوظبي وانتهت عدتها. حُكم لها في محكمة أول درجة في أبوظبي بمؤخَّر الصداق ونفقة العدة ونفقة المتعة ورُفض طلبها بنفقة أجرة سكنى العدة على استقلال لشمول نفقة العدة المحكوم بها ضمن مشتملاتها على هذا الطلب، ورفض طلب بدل الضرر المادي والمعنوي. أتفهم الحكم وأنا على استعداد لدفعه، ولكنها استأنفت الحكم بمطالبة بزيادة النفقات والحكم لها بأجرة مسكن عدة وبدل الضرر. علمًا بأنها طوال فترة العدة كانت تسكن في منزل والدها بإرادتها ولم تطلب المجيء لمسكن الزوجية الذي استأجرته وكان ما زال مؤجرًا طوال فترة العدة. سؤالي: هل سيُحكَم لها بنفقة سكنى العدة لمدة ٣ أشهر مرة خاصة أنه لا يوجد أطفال وهي ليست حاملاً؟ وماذا عن طلب بدل الضرر؟ أرجو المساعدة بهذا الخصوص. وشكرًا!

Q: Dear Sir, My wife and I are both residents of the UAE and are both Muslims, married in India under Sharia Law, and registered in the UAE. While my visa is sponsored by my company in Dubai, she is staying with her parents in Abu Dhabi. We are not staying together since Sept 20 as she was not a good wife to me. Hence I request you to please advise me why they asked for my salary certificate. Will they ask me to pay monthly maintenance to her? If yes, then how much would it be monthly? Does the maintenance come under Sharia law even though we are not divorced yet?
