The amount of maintenance for the wife decided by court after separation

Dear Sir,

My wife and I are both residents of the UAE and are both Muslims, married in India under Sharia Law, and registered in the UAE. While my visa is sponsored by my company in Dubai, she is staying with her parents in Abu Dhabi.

We are not staying together since Sept 20 as she was not a good wife to me. We don’t have any children. In Jan 2022, she filed a maintenance case against me in Abu Dhabi court. There was a video conf. call with personal status court.

Yesterday, I got another message again from the court to attend the video conference call. The next date they gave us was on 17 May 2022.

Hence I request you to please advise me why they asked for my salary certificate.

Will they ask me to pay monthly maintenance to her? If yes, then how much would it be monthly?

Does the maintenance come under Sharia law even though we are not divorced yet?

Please note that she has blocked me over WhatsApp, kept on abusing me from time to time since she is with her father and many more bad things from her relatives' side.

Thanks.

Dear Questioner,

Yes, it is under Sharia Law for your wife to claim the monthly maintenance as long as she is your wife, the amount depends on your salary, other expenses, and the decision of the judge.

Thank you Maryam for the quick response.

Could you please advise what is the percentage of my salary that can be given to her on monthly basis?

In between this case, can I go ahead with filing a divorce under Sharia Law from Dubai?

Will filing the divorce in between this ongoing maintenance have a negative impact on my divorce petition?

Do I need to hire a lawyer for divorce purposes or an ongoing maintenance case filed by my wife?

Dear User,

Kindly note that you can choose between applying the law of India or the law of the Emirates. In this type of case, it is impossible to win the client without using a lawyer.

Step one, we need legal power of attorney to read what an opponent wrote.

In the second step, it is important for a husband to Sue his wife.

Kindly send us your email, or your phone number, and one of our lawyers will get in touch with you as soon as possible, to discuss your situation and answer all your queries.

Thanks, Aws for the reply.

Can I go with filing a Sharia divorce from Dubai or Sharjah?

How filing divorce will conflict with the already ongoing case of maintenance which is filed by the wife's side?

These two cases will run in parallel?
