Forcing the employer to cancel the visa and take another job

Hello.

Kindly advise on the following matter.

I am employed in the free zone in Dubai. My name is in the trade license and I am registered in the company as a manager. In March, I resigned from the company.

The employer doesn't want to cancel my visa and to revoke me from the license.

Authorities of the free zone told me they cannot do anything because my name is in the license and employer has to first appoint another manager and then cancel my license.

In case they don't want to do it, I can only go to the court (they don't know which type exactly...).

How can I enforce my visa cancellation? Only by court order? Which kind of court? I have found another job but I'm stuck on the old company visa.

Please advise.

Thank you

Dear Questioner,

Are you a partner or only a manager?

20 Aug 2019, 12:55

I was a partner at the start when the company was established, but we did share transfer later on from me to the other partner.

He is the only shareholder now. I am an employee.

Share transfer has been done 3 September 2018.

My visa is valid from 24 September 2018.

Free zone: DMCC

As you are not a partner and only manager, the applicable law is the UAE Federal Labor Law.

You can make a complaint in Tasheel\MOHRE, and once it's transferred to the court we can represent you and help.

Kindly contact us for more information by phone or email.
