Q: Hi,
I am Z. A.
My employer is not paying my salary for 3 months now plus another pending amount, and my contract is expiring on 8th May 2019.
I got an offer letter from another company and I resigned from my job.
My query is if my employer does not cancel me after one month or if he does not pay all my dues, what should I do to get cancelled and get my dues paid without losing the new job offer?
Please help me out.

Labour rights upon resignation for non-payment of salary

Q: Dear Ahmed,
My sister is working for a catering company based in a school and she didn't get her salary since May. She doesn't wish to continue with this company.
Her contract is limited and joined in September 2017, but the contract is dated 04/12/2017.
As per article 121, she has the right to resign without notice, however, another article says that she needs to pay the employer “early termination compensation”.
How can we proceed without losing the money?

Cancellation of visa upon resignation and getting EOSB

Q: Good evening Sir,
I am H., working as Asst. Manager under an unlimited contract, and now I completed 4 years and 10 months at this company.
I have resigned from the job effective 01.06.2019, and on a 30 days notice period. My boss instructed me to withdraw my resignation letter and give an apology letter, but I refused politely.
Last week, they accepted my resignation and they instructed me to vacate the accommodation. On 16.06.2019, I vacated my company accommodation and handed over all the things that belong to my company.
The facility of the motor car was revoked on May 30. My HR manager said (verbally) you can stop your duty, but he is not ready to send an official email.
Still, every day I am going to the office by taxi. Now, they are forcing me to sign the cancellation paper. I asked about my gratuity but the HR manager is saying you have to sign cancellation paper letter we will process your gratuity.
Sir, I am kindly requesting you to advise me on the procedure of how I can solve this issue in a professional way.

س: ما الإجراء القانوني مع موظف تقدَّم باستقالته عن طريق البريد الإلكتروني ووضع جميع الموظفين وأصحاب العمل بالبريد الإلكتروني، وبعد يومين، تقدم بشكوى عمالية ضد المنشأة يطالب براتب شهر عن عمله من المنزل أثناء إجازته السنوية المدفوعة بالكامل بالفعل؟
لم يطلب منه مديره المباشر أو أصحاب العمل أن يعمل أثناء إجازته لا شفهيًا ولا كتابيًا مع العلم أن عقده غير مُحدد المدة ويعمل منذ ٣ سنوات ونصف.
هل يجوز أن يُكمل شهر الإنذار بعد تقدمه بشكوى عمالية؟

Q: I am working in a construction company as an engineer with a limited contract visa.
Now, there is a 4-month salary pending, Due to this, I am facing a huge financial crisis. I got a better opportunity,
I had given my resignation to the current employer. They didn't even reply to my resignation letter regarding when they should release me.
What should I do now?
If they don't release me, I will lose my new job offer!

How to claim pending salaries and EOSB after resignation

Q: Hello
I have been working for a company in Dubai for 3 years, and in the current year, the company didn't pay salaries. Overall now, I have 8 months worth of pending salaries + the other end of service benefits.
I was chasing them around for months and got tired of it, so I resigned. I filed a complaint against the company, but for 3 weeks the company never reached out for settlement, so finally, I registered a case against the company in court.
I am on my husband's visa & my work permit expired months back. What I want to know is:
1. Now that I have registered a court case, what's going to happen next?
2. Will I have to visit court, every time for hearings?
3. I am looking for a new job here, will this court case be any issue in me getting a new job or new employer issuing a new work permit and what can I do to ease the process of new work permit?

Q: Hi Ma'am,
Good Morning!
I am working in an LLC company in Dubai. I signed an unlimited contract in the month of April 2021. Now I am not satisfied with this company and salary pending is the reason to resign.
Will there be any consequences if I resign within 6 months? My VISA belongs to the employer and my passport is also with them.

Q: Dear Sir/Madam,
I recently filed a complaint with MOHRE and received a call from them today asking for my claims. I am working as an electrical engineer under a limited contract.
My start date was March 10, 2022, but my labor contract was not completed until April 24, 2022.
- My offer letter states that my salary is 25,000 AED per month, but my employer made my labor contract state that my salary is 15,000 AED per month. The employer has paid me partial salaries as he wished, sometimes 25,000 AED and sometimes 15,000 AED. As of today, my partial/pending salaries total 150,000 AED in 14 months of service.
- The employer has failed to provide me with medical health insurance. Also, as per my offer letter, the employer agreed to provide medical health insurance to my family. However, the employer has failed to reimburse me for any submitted bills.
- The employer has failed to pay my annual leave.
In such a scenario, what will happen with MOHRE? Can I resign and join a new company without affecting my settlement claim?
Should I apply for 1-month leave as per my right and look for a new job?

I want to inquire regarding my leave privileges. I am now 11 months in my company. How many leaves am I privileged to?
Based on Decree-Law No. 33 of 2021 regulating labour relations and its executive regulations, you are entitled to a paid weekly rest for not less than one day, as specified in the work contract or the work regulation.
The Council of Ministers may increase the weekly rest day stipulated in this article. The Decree-Law and its executive regulations also stipulate that you are entitled to an annual leave with full pay as follows:
- Thirty days for each year of your extended service.
- Two days per month in respect of any employee with more than six months and less than one year of service.
- Leave for parts of the last year of your service in case it is terminated before you use your annual leave balance.
Now my question is: do I have 22 days I can use? Can someone explain to me in detail?

I worked in my company for 8 years and was terminated on the same day specifying redundancy as the reason. The company paid me all the dues (1 month notice period salary, gratuity, and unpaid leave salary).
