What to do if the salary is not paid for 5 months and the visa is expired?

Dear Sir,

Greetings!

I have been working for 7 years in a construction company in Dubai with Abu Dhabi visa.

My visa expired in March 2020. It has not been renewed till now and a 5-month salary is pending.

Can I join another company without a notice period?

How will I get my settlement and salary?

Dear questioner,

Based on the labor law of the UAE, you have the absolute legal right to sue your employer if he stopped paying your salary for more than two months.

According to your inquiries, you did not receive your salary for more than 5 months which exceeds the period mentioned by the law.

Apparently, you can file your labor complaint against your employer to claim any pending salaries, plus 9% legal interest due to delay of payment, and oblige your employer by legal force to pay your outstanding fines which are resulted from him.
