ماذا أفعل في حال اتهمتني الشركة بخيانة الأمانة بسبب المطالبة بالرواتب المتأخرة؟
س: الشركة تتأخر كل شهر بدفع المعاش وأشهر تعطي بالأقساط وآخر شهرين دفعت نصف معاش. ومن بعد ما استمريت بمطالبتهم كل شهر قلت يكفي كل مرة أطلب حقي وكل الموظفين نفس الشيء. وفي الأخير تم اتهامي بخيانة أمانة وتمت إقالتي. ماذا يمكن أن أفعل؟ أنا بالكويت

هل يحق لمكتب تأجير سيارات رفع قضية خيانة أمانة علي في حال التأخر بالسداد؟
س: السلام عليكم أنا كنت مستأجر سيارة لأكثر من سنة من مكتب تأجير سيارات وتأخرت في السداد تقريباً شهرين ونصف وتواصلت مع المكتب لأسدد جزء من المبلغ وأكمل الباقي بعد بضعة أيام. رفض المكتب الموضوع بأن أسدد جزء من المبلغ. في اليوم التالي ذهبت للمخفر وأجريت إثبات حالة واستلم المكتب السيارة في المخفر. هل يحقق لمكتب السيارات رفع قضية خيانة أمانة علي كما يقول لي صاحب المكتب مع العلم أنني لم أسدد المبلغ إلى الآن؟2023/04/14

Do I need a contract with the new landlord to hand over new cheques?
Q: Dear Sir/Madam, My rental contract ends in November 2023, but my landlord has sold the apartment. Also, she sent me a notice in November 2022 to vacate in November 2023. My questions are: - Do I need to have a contract with the new landlord to hand over new cheques to him? Or a written document at least? He is asking me just to give him the cheques. - If he does not wish to renew my contract in November 2023, when and how shall he communicate that to me? Note: my current rental contract is not in Ejari as the previous landlord didn`t register it, but it was created through a typing center as per the recommendation of the Dubai Land Department and signed by her.

Q: My company is asking us to do 9 hrs. duty this Ramadan starting last 8th of April 2023 without overtime pay. And no one from my colleagues wants to complain as they are scared of what might happen. Just today, my showroom manager is asking me to extend until 12 pm when I started my duty from 10 am and I am fasting. What can I do?

How to release my EOSB from the bank after changing jobs and submitting documents?
Q: Hello, My bank is not releasing my EOSB. I resigned from my previous company after 10 years with them as I will be transferring to another company. I just started a week ago. I was told by my bank that they will not release my money since my salary is AED 1,000 less than what I previously earned. My current salary is still able to cover my liabilities with them. I even inquired with them last month and informed them of my resignation and was told that as soon as I submit my documents from my new employer, they will release my money. This was not the case now. Please help. I don’t have any plans of leaving the country and willing to continue with my payments. I’ve never missed a payment with them.2023/04/13

How can I appeal a case if I missed the hearing and defending myself?
Q: I had a misdemeanor case in Dubai last January 28, 2023, then I was released on January 30 after a judge hearing. Now the judge asks me to submit a translated Arabic appeal letter for my explanation and seek help from the police officers. Unfortunately, no one can help me and assist me. They just released me the same day right away after the hearing without submitting my appeal. Then, they told me to wait for a call from Dubai Courts. Unfortunately, after waiting, no one called me so I followed up after a couple of days, but still no one replied to me. I even mailed the Dubai Police and they just said it was forwarded already to the HQ. I have to wait for a call. 2 weeks ago I received a call from them from Barsha telling me that I have to go to Dubai Courts. Then when I checked online, I found out that there is already a final judgment of 1 month of jail and deportation. Ma`am/Sir, I need to defend myself and submit an appeal because I have valid reasons why things happened at that time.

What can I do if my ex-wife is not cooperating to renew the visa of her and our son?
Q: I am legally divorced since 2015 in the UAE and paying sustenance to my wife for our son (15 years). Son is under the sponsorship of my ex and she is not renewing her and my son`s visa. My son has no visa or medical insurance. I am willing to sponsor my son however, my ex is not cooperating. My ex-wife is not working or earning either. What can I do? I want to protect the legal status of my son and have proper health insurance for him. Which government department can I report this matter to? Your advice will be appreciated.

Can the employer refuse to pay my dues after termination if I lost charger of work laptop?
Q: Hi there So yesterday I went through a mutual termination dismissal. I handed in the work laptop but I lost the charger. I asked the HR lady that from my final pay, they may deduct the amount of the charger and the laptop back which all amounts to R700. She emailed me that they are declining that arrangement. Q: Dear Sir/Madam, Today, I received a notice of termination under Article 115-Redundancy. My contract in JAFZA began on October 10, 2020, and the end date is October 10, 2023. I need your help to understand if the term "month" refers to 20 or 30 days and if payment will be based on basic salary or full salary. Regarding my termination, they have mentioned the following payments: - Salary until April 12, 2023. - Salary in lieu of the notice period. - Three months` salary as compensation for early termination. - Leave encashment until April 12, 2023. - End of service gratuity until April 12, 2023. - One-way air ticket for repatriation to my home country, only if I exit the country. As per their request, I signed the acceptance on the notice document and returned the company phone and laptop. I would like to know if it is possible to file a complaint for any additional compensation as this termination has caused me financial distress, especially since I have to pay monthly installments to the banks for the next four years.2023/04/12

Can the seller force the broker to pay security deposit if the buyer breaches the MOU?
Q: Hi. I would like to ask a question regarding the real estate property sale agreement. We are brokers and we had a client who wanted to buy a property in the UAE. The seller was selling it for 2.1M and the buyer agreed to that price and they both signed the MOU. In the MOU there`s an article mentioned that the buyer and seller must each submit a security deposit cheque amounting to AED 100,000 that we the broker will keep and be returned to both after a successful transaction. And there is another article stating that if ever any of the parties cancel or withdraw from the agreement period which is 15 working days, then the security deposit will serve as a penalty and then be disbursed to the broker and the damaged party. In this case, the BUYER didn`t give us a security deposit cheque and then he canceled after a few days. Now the SELLER is pursuing a legal case against the broker and the BUYER and the buyer is not responding to calls or emails. What are the legal cases for this?

The court has ruled that I am not entitled to a custodian housing allowance because I obtained khula, but this is against the law. Can the bank withhold my EOSB after changing jobs and providing all documents?
Q: I have a loan from a bank and I have changed my job, the bank is holding my end of service. It`s been 4 months now and my new salary is transferred to them and I never defaulted on a payment. what to do? Noting that my new salary is higher than the old one but the bank is claiming that my new company is not registered with them and rejecting to release the amounts. P.S. The original loan amount is 550K (including interest) balance amount to be paid is 380 K and my EOS is 195K.
