How to cancel the brokerage management contract of a property to be able to rent it?
Q: I`m currently in the process of leasing the property and as part of the standard procedure, we attempted to register the tenancy on the Ejari system. However, we encountered a persistent error message indicating that the property is currently managed by an independent brokerage agency. In an effort to resolve this matter promptly, we reached out to the broker company and were informed that a payment of AED 300 is required to process the Ejari registration. In good faith, we transferred the requested amount to facilitate the registration process. To our surprise, the broker company has since communicated that they have applied for the cancellation of the management contract for the said property and are now requesting to return the AED 300. Despite their assurance of canceling the contract, we are still unable to register the property on the Ejari system. Given the urgency of the situation and the fact that the tenant`s move-in date was January 15, 2024, we are seeking legal advice. أسئلة وأجوبة

Q: Dear Sir/Madam, Kindly advise; your response is appreciated. I`m an HR in a contracting firm with about 300 employees, including 200+ laborers under the company visa. We are in the process of policy renewal. One of our laborers suffered a heart attack and was taken to the hospital, but his insurance has expired. The bills amount to 35k, and the hospital is requesting payment. Our boss and company are not ready to pay. The laborer`s minimum salary of 1700. Do I have to compensate my employer if I resign during probation and what is the notice period?
Q: Greetings! Can I terminate my contract during my probation period? As it`s written in my contract that 3 months notice period is required for both parties when terminating the contract. Also, it`s written that I need to pay AED 6000 as a training fee if I would resign by my own willingness before 1 year. Financial firm wants to change investor contract; I disagree. What now?
Q: Dear Sir/Madam, I had invested in a financial firm registered in DED. It is a secured product, and a fixed monthly return was guaranteed as per the contract. I received returns regularly from September 2021 till December 2023. Now, somebody has complained to DED against the company for crowdfunding and using money for trading. The company is in the process of obtaining a DIFC license. They want to change the existing secured product contract to an unsecured product in which the company is not liable for loss. I bought a tenanted unit, and it is sublet. Can I get compensation?
Q: Dear Sir, I bought a tenanted unit, and the tenancy contract was signed by one person. Shortly after, I found out that more people are living in the unit, and the tenancy contract doesn`t allow subletting. I contacted the phone number in the contract via WhatsApp, chatted with a woman, and highlighted the problem. She referred to the men living in my unit as "tenants." At the end of our conversation, I learned that she is not my tenant. The tenant in my tenancy contract is a man, and I`ve received his Emirates ID from the previous owner. He doesn`t live in the unit, and the phone number and email address in the contract, given as his, are not his own. Is this legal? Is the contract still valid? I would like to give my tenant an eviction notice because of subletting. I`ve found online that I have to give him a 30-day notice. Is that correct?
