Q: Dear Lawyers,
I have been employed at DIFC since May 1st. They want to fire me without notice, citing a probation period of 3 months, but my contract did not specify a probation period.
Among other things, my contract states that I must be notified 1 month in advance. They have now sent me a screenshot from the DIFC portal prescribing 3 months of probation, but this was not in the contract I signed.
Additionally, the company has not provided me with insurance yet, also citing the probation period.
Is the company violating my rights?

لقد كنت أعمل لدى شركة تابعة للمنطقة الحرة بمطار دبي لمدة 11 شهرًا بموجب عقد عمل غير محدد المدة بصفتي مدير تطوير أعمال.
يقع المقر الرئيسي للشركة خارج دولة الإمارات ولقد صدر خطاب عرض العمل في 1 أكتوبر 2018، وبدأت العمل في الأول من أكتوبر.
لكن عقد العمل الخاص بي (عقد غير محدد المدة) الصادر من المنطقة الحرة صدر بتاريخ 19 نوفمبر 2018. بناءً على ذلك، ما هو التاريخ الفعلي لبداية عقد العمل؟ هل يحق لي الحصول على شهر واحد بالإضافة إلى 19 يومًا عند تسوية مستحقات نهاية الخدمة الخاصة بي؟
لقد تم إنهاء خدمتي شفهيًا بتاريخ 04/09/2018 وبعد إرسال بريدًا إلكترونيًا للمتابعة، أصدروا خطاب إنهاء كتابي بتاريخ 10/09/2018 يشير إلى أدائي في العمل والذي لم أوقع عليه حتى الآن.
لذلك، يرجى إخباري بشأن ما إذا كان خطاب الإنهاء هذا صالحًا دون توقيعي بقبول ذلك؟
لقد أعطوني فترة إشعار مدتها 30 يومًا ولكنى لم أضطر إلى العمل. هل يحق لي المطالبة بتعويض يصل إلى راتب ثلاثة أشهر عن الفصل التعسفي حيث أنني لم أحصل على وظيفة حتى الآن؟
يرجى تقديم المشورة لي بشأن ما إذا كان يحق لي الحصول على راتب الإجازة. إذا كانت الإجابة بنعم، فكم عدد الأيام المستحقة لي؟

This is regarding an enquiry about a case where we were acquitted by the first instance court, that is, the trial court.
The prosecution appealed the judgment, and we also received an acquittal verdict from the misdemeanour appeal court.
I know there are still 30 days, but what are the chances it can be appealed to the Court of Cassation?

I sent the USDT. I didn't know the person who sent the money to my account, so I gave him the USDT. Later, I was arrested for scam and using cryptocurrency without a license.
The judgment came out: to pay 900 AED, 1 month imprisonment, and deportation. Please, can I appeal not to be deported?

How to reduce agreed salary deductions if they are too high and affect our livelihood?

I work for a company in the field of technical works related to interior decorations, and during my work, for technical reasons, some materials that belonged to the company and that we use in our work were damaged, and which should have been secured in a certain way.
My coworkers and I were punished by deducting the value of the materials from our salaries, as the company deducted 15 days per month until the full amount was paid.
The first deduction was made last month, which causes us a lot of harm, as it is difficult for us to face living with the remaining amount.

How can we claim our money back if the cheque we received have bounced for insufficient funds?
We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day.
We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds."
We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it.
We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.

Am I required to replace an old fridge owned by the landlord if it can't be repaired?

My rental here in Dubai comes with a fridge and cooker. I believe these to be at least 10 years old. The fridge has now stopped working and requires a part to be replaced.
This comes at a cost of 540 AED, which is over the agreed amount that I am responsible for. My Ejari comes with an extra addendum provided by the landlord, which states:
1. The landlord is responsible for major maintenance of the apartment (namely structural, electrical, and plumbing) exceeding 500 AED + 5% VAT. The tenant is responsible for any minor maintenance as needed as a result of wear and tear.
2. The property is leased with the following assets (fridge and cooker) owned by the landlord in working condition and should be returned in the same condition. Any maintenance required is the tenant’s responsibility.
My question is:
If I'm unable to fix this fridge, do I have to provide a new one? The company looking to repair the fridge is having an issue finding the part needed, as it is old.

How to clear name and go back if you left the UAE with an unpaid personal loan?
My brother had a personal loan of 300k.
He lost his job, and the company terminated him, and his visa was cancelled, so he moved back home in 2015. He is trying to find a job back in the UAE.
Is there any way to get him cleaned, paying the court fine?
The bank he had a loan with has been merged with other groups, and he doesn't know who to contact.
Repayment is impossible without a job, and finding a job at the age of 50 is not an easy task.
