س: مرحبا راجاسري، 1- تنص اتفاقية الإيجار على أنه يجب دفع إيجار الشقة على ثماني شيكات. لم يتم ذكر ما إذا كانت شيكات مؤجلة الدفع أم أنها شيكات مدفوعة مقدمًا. 2- لا يحدد عقد الإيجار وجوب تقديم الشيكات مقدمًا أو أنها يجب أن تكون شيكات مؤجلة الدفع. 3- أقوم بسداد دفعات الإيجار الخاصة بي أولاً بأول. 4- بما أن عقد الإيجار لم يحدد أنه يجب عليّ تقديم الشيكات مقدمًا، فإنني أريد تقديمها في الوقت المناسب عند استحقاقها. 5- يطلب مني المالك تقديم شيكات مؤجلة الدفع ويدعي أن ذلك خرقًا للعقد. 6- أرسل لي المالك إشعارًا مدته ثلاثة أيام لتقديم الشيكات مؤجلة الدفع أو دفع الإيجار بالكامل. 7- المالك يرفض إعطائي نسخة من عقد الإيجار موقّعة من جانبه. 8- أنا لست متخلفًا عن السداد ولا متأخرًا عن دفع الإيجار - كيف يمكنه أن يهددني بإشعار مدته ثلاثة أيام ويطلب مني شيكات مؤجلة الدفع في حين أن عقد الإيجار لا ينص على ذلك؟

Q: Sir, I have released 7 post dated cheques for house renting on January 12. January 15 is the date of the 1st cheque which is valued 9k. But on January 15, my bank froze my account because my company terminated me. So I told them to not withdraw the cheque coz I got no money in it and I'm cancelling that property. When I asked them I need to collect my cheque, they told me I cannot. Not unless I pay them 9000. Do they have the right to do this? I am in a deep problem as they filed a case against me regarding this. So, I want to know. Thank you.

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai. 

This Decree establishes a specialised judicial system to hear rent disputes and develops the procedure for determination of such disputes through an expeditious and simple process for the purpose of realising social and economic stability for all persons involved with the real property rental and other related sectors.
