How to stop my employer from cancelling my visa as it needs to be active in the process of golden visa?
I am in the process of applying for a golden visa, and the nomination letter from Creators HQ will take up to 4 weeks.
In the meantime, my previous employer has started my labour card cancellation.
Amer has told me that my visa and labour card need to be active before my golden visa is issued.
How can I stop my former employer from cancelling my labour card and visa?
To stop your former employer from cancelling your labour card and visa, communicate directly with them, requesting a delay based on your golden visa application needs.
If unsuccessful, seek legal advice and contact relevant authorities for assistance.
Under UAE law, an employer is not allowed to cancel a labor card or residency without the employee’s knowledge, especially if the employee is in the process of transferring to a Golden Visa.
You can file an urgent complaint with MOHRE to stop the cancellation.
Our legal center specializes in visa matters, Golden Visa applications, and labor disputes, and you can contact us via WhatsApp for more details and immediate legal support.
Hello,
Negotiate with your employer (if possible).
If the employer refuses to cooperate, you can contact the Ministry of Human Resources and Emiratisation (MOHRE) and file a request to delay the cancellation, explaining that you're in the process of a Golden Visa application.
Dear Client,
Thank you for reaching out regarding your Golden Visa application and the concerns about your labour card and visa status following the initiation of cancellation by your previous employer.
You are correct that, for the Golden Visa to be processed smoothly, your current residency and labour card should remain active.
However, as your previous employer is your legal sponsor, they are within their rights to proceed with the cancellation once your employment has ended.
While you cannot legally compel them to delay the process, there are practical steps you can take to request a short extension.
How I Can Assist You:
- Drafting Formal Requests: I can assist in preparing a formal written request to your former employer, clearly explaining your Golden Visa application status and the importance of maintaining your residency until the process is complete.
- Advising on Supporting Documentation: Guidance on what evidence or documentation to provide to your employer or the authorities to strengthen your request.
- Liaising with Authorities: Support in communicating with Amer centers or the Federal Authority for Identity, Citizenship, Customs & Port Security (ICP) to seek official guidance or intervention.
- Negotiation and Mediation: If needed, I can help mediate with your employer or provide legal representation to negotiate a short extension.
To proceed, please provide your contact number or let me know a convenient time for a call so we can discuss your situation in detail and outline the best strategy to protect your residency status during this critical period.
