س: يرفض المالك إعادة مبلغ التأمين.
لقد قمت بإخلاء الشقة التي استأجرتها واستوفيت كافة الشروط وفقًا لعقد الإيجار (قمت بطلاء الشقة، وأصلحت ونظفت كل شيء، ولقد أقر ممثل المالك بذلك كتابيًا، وقمت بإلغاء كافة خدمات المرافق وخدمات إيجاري وسلمت طلبات الإلغاء للمالك).
لقد أخبرني ممثل المالك عند إعادة المفاتيح بأنه سيتصل بي عندما يصبح شيك إيداع التأمين جاهزًا. لكنه لم يتصل أبدًا، ولم يتم الرد على طلباتي الواردة عبر البريد الإلكتروني، وتم تجاهل مكالماتي منذ ذلك الحين. لقد مر أسبوعان بالفعل حتى الآن.
لديّ دليل على تسليم شيك التأمين (بواسطة وكالة العقارات التي رتبت تأجير الشقة)، وأنه تم الاحتفاظ به بواسطة المالك كما أن هناك إقرار خطي يُفيد بأن الشقة تم تسليمها دون أي مشاكل.
ما هي الطريقة الصحيحة والأكثر فعالية من حيث الجهد والوقت لجعل المالك يفي بالتزاماته ويعيد لي وديعة التأمين؟

س: مرحبًا.
عاشت ابنتي في دبي من 1 مايو 2017 إلى 31 يوليو 2018 في شقة استأجرتها من شخص أمريكي الجنسية.
كان العقد الأول لمدة عام وتم تمديده لمدة ستة أشهر. كان للعقد الأصلي شرط ينص على الإخطار لمدة شهرين، والعقد المجدد يلزم بفترة إخطار مدتها شهر واحد.
تم إعطائه إخطارًا شهريًا وفقًا لاتفاقية الإيجار في 25 يونيو 2018 عبر البريد الإلكتروني وعبر الهاتف وتم الإخلاء في 31 يوليو 2018. وعادت إلى الهند في 8 أغسطس 2018.
المالك الآن لا يستجيب لرسائل البريد أو الرسائل الإلكترونية، ولم يرد أي أموال. المستحقات عبارة عن إيجار لمدة ثلاثة أشهر ومبلغ التأمين، بمبلغ إجمالي وقدره 15600 درهم.
عادت هي الآن إلى الهند ولم تعد قادرة على السفر لفتح قضية في مركز فض المنازعات الإيجارية. كيف يمكنني استعادة أموالي التي كسبتها بشق الأنفس دون السفر إلى دبي؟

س: إلى من يهمه الأمر،
لقد واجهت مؤخرًا مشكلة مع وكيلنا عندما أخلينا العقار. استأجرنا العقار لمدة عامين ودفعنا وديعة التأمين. لقد انتقلنا من المكان لأن الوكيل قام بزيادة الإيجار بأكثر من مؤشر مؤسسة التنظيم العقاري.
لقد مر الآن ما يقرب من شهر ولم نتلق مبلغ التأمين بعد. أعطانا الوكيل الفاتورة التي تتضمن؛ صيانة تكييف الشقة، وتوريد واستبدال سخان المياه بالأنابيب (أعمال السباكة).
جميع التكاليف الأخرى لا بأس بها مثل إعادة الطلاء واستبدال المفصلات. لكن الأولين غير مقبولين من وجهة نظري.
هل يُسمح لنا بتسجيل نزاع مع المالك، إذا لم يعيد الوكيل مبلغ التأمين، فهل يجب علينا تقديم شكوى؟
نحتاج إلى مشورة خبير رجاءً.

Is there a timeframe for a property maintenance claim after vacating the apartment?

Q: Upon vacating your apartment, can you sue your landlord for ongoing maintenance issues while you lived there?
For 3 years I had ongoing maintenance issues which the building would not fix properly.
Furthermore, they have now tried to deduct from my security deposit despite not fixing several issues that occurred in the past 3 years!
Is there a timeframe for a maintenance claim?
I would like to sue them for years of lack of maintenance which destroyed my experience while living there.
Please advise.

Can the owner of a company escape if there is a cheque execution and travel ban on him? 0
I raised a cheque execution case against a company and its owner and won. There is a travel ban on him. I was receiving installments for three months and now he stopped paying.
The court after request summoned him. In total, he paid only 30% of the owed money. I found that his company license is expired and also in the month his visa will expire.
Does he have any option to avoid payment?
Please note he was deceived by showing no money in his bank account and no assets in his name but he is running multiple businesses.
Also a month ago, he tried to convince me to lift the travel ban but I refused to do so. But he submitted a guarantee and left UAE.
Now the status shows he is back in the UAE and the travel ban imposed again. But after that, he stopped payment.
Is there a 1% chance of him not paying me the remaining money?
Is there a way he can leave the country through the Amnesty program or any of this sort?

Hello,
I purchased a one-bedroom off-plan unit in Dubai from a well-known developer under an SPA specifying an area of 801 sq. ft. I completed all payments as per the developer’s payment plan, and the unit was handed over to me without a Title Deed.
After taking possession, furnishing the unit, signing a tenancy contract, and making repeated follow-ups to obtain my Title Deed, the developer informed me, 45 days after handover, that the actual area was 1,041.41 sq. ft., a 30% increase from the original SPA terms.
To receive my Title Deed, they are now demanding payment for the increased size.
Key issues:
- Failure to notify me before handover about the 30% increase in area.
- The SPA allows for price adjustments for area variations but specifies that such adjustments must be reflected in the final installment, which I had already fully paid before handover.
- The developer has now filed a legal case through Dubai Courts, demanding payment.
I require legal advice based on RERA/DLD laws and the SPA.

My cousin has multiple penal judgments of fine and jail. How will this be calculated? 0
My cousin is in the central jail of Al Awir since October 2024 till date 20/03/25. She has 6 different penal cases all judgements are done, last one was done yesterday.
In total, she has a fine of about 135000, 1 month in jail, and deportation in 1 case.
How will this be calculated moving forward?
