Is there a timeframe for a property maintenance claim after vacating the apartment?
Upon vacating your apartment, can you sue your landlord for ongoing maintenance issues while you lived there?
For 3 years I had ongoing maintenance issues which the building would not fix properly.
Furthermore, they have now tried to deduct from my security deposit despite not fixing several issues that occurred in the past 3 years!
Is there a timeframe for a maintenance claim?
I would like to sue them for years of lack of maintenance which destroyed my experience while living there.
Please advise.
Thank you.

After vacating your apartment, you may not be able to demand any maintenance claims.
But you still can demand your security deposit in full.

Hi,
A landlord is responsible for maintaining the property in good condition and ensuring that it is fit for the purpose for which it was leased.
Therefore, if you have faced ongoing maintenance issues during your tenancy, you may have grounds to file a claim against your landlord.
In order to file a claim, you will need to provide evidence of the maintenance issues, such as photographs, repair invoices, and any communication with the landlord or building management regarding the issues.
It is also important to note that there is a statute of limitations for filing a claim, which is 15 years for contractual claims in the UAE.
In your case, since you have already vacated the apartment, it may be more difficult to prove the ongoing maintenance issues.
However, you may still be able to file a claim for the issues that occurred within the last 15 years.
Additionally, you may also file a complaint with the RDC, since, the landlord has not returned your security deposit or has deducted from it without valid reasons.
These authorities have procedures in place to resolve disputes between landlords and tenants.
