Employer agreed to settle before MOHRE. What if they don’t pay the promised amount?
Hello,
I already have a dispute order with MOHRE. Then my employer became willing to settle the case.
What should I do in case they do not follow through with the promised amount to pay?
Dear Client,
Thank you for your inquiry regarding the appropriate steps to take if your employer does not honor the agreed settlement amount following a dispute filed with the Ministry of Human Resources and Emiratisation (MOHRE).
If your employer fails to pay the promised settlement amount after an agreement has been reached and documented through MOHRE, you are advised to take the following actions:
1. Notify MOHRE of Non-Compliance:
Immediately inform MOHRE that your employer has not fulfilled the terms of the settlement. Provide any supporting documentation or evidence of the agreement and the employer’s non-compliance.
2. Request Enforcement of the Settlement:
MOHRE has the authority to issue a final, legally binding decision in cases where a party fails to comply with an approved settlement. This decision carries the same weight as a court judgment and can be enforced accordingly.
3. Consider Legal Action if Necessary:
If the employer continues to disregard the settlement, you may escalate the matter to the competent court for further enforcement. MOHRE’s decision can be used as evidence in court proceedings.
4. Appeal Process:
Should you or your employer wish to contest MOHRE’s final decision, an appeal may be filed with the competent court within 15 days of notification. If no appeal is filed, the decision remains final and enforceable.
We recommend that you keep all correspondence and records related to your case and consult with a legal advisor if you require further assistance.
Should you need any additional support or clarification, please do not hesitate to contact MOHRE directly or seek legal counsel.
Best regards,

Let the dispute be settled in MOHRE, so a decision will come with the settlement, and it will be binding. In case they don’t fulfill it, you can use that decision to go to court.
Make sure you have clear documentation of the settlement agreement. This could be in writing, outlining the agreed payment amount and timeline.
If the payment is delayed or doesn't arrive, your first step should be to politely but firmly contact your employer. Remind them of the agreed-upon settlement and the due date.
Since you initially filed a dispute with the Ministry of Human Resources and Emiratisation (MOHRE), you should inform them that your employer has not honored the settlement agreement.
Provide them with copies of the settlement agreement and your formal demand letter. MOHRE may be able to intervene again to facilitate the payment.
Dear questioner,
Make an agreement with the employer on their letterhead along with the trade license details.
If they breach the contract, you can initiate a civil case or a labor case if the settlement is through the direction of MOHRE.
Dear Inquirer,
If your employer has agreed to settle but fails to pay the promised amount, you can request MOHRE to reopen the case or escalate it to the labour court for enforcement.
It’s important to document the settlement terms clearly and act promptly if they breach the agreement.
To protect your rights and take the correct legal steps, we recommend you book a consultation or assign our office to handle the case on your behalf.
According to UAE law, if the employer fails to adhere to the agreed-upon payment amount, you can file another complaint with the Ministry of Human Resources and Emiratisation (MOHRE) or proceed to court to enforce the settlement agreement.
You can also negotiate with the employer for an amicable resolution or consult a specialized legal center for further assistance in recovering your rights.
